1. That the cancellation is,consistent with the purposes of the Williamson Act. <br /> a. The cancellation is for land on which a Notice of Nonrenewal has been served pursuant to <br /> Section 51245 of the Government Code. <br /> This subfinding can tie made because the Community Development Department <br /> approved a Notice of Nonrenewal on February 15,2006. <br /> b. The'cancellation isnot likely to result in the removal of adjacent lands from agricultural use. <br /> This subfinding can be made because the property to the east of this site is not under <br /> contract, and only 4.458 acres of land is to come out of contract. <br /> C. The cancellation is for an alternative use which is consistent with the applicable provisions of <br /> the County General Plan. <br /> This subfinding can be made because the cancellation is to facilitate a Lot Line <br /> Adjustment to move a property line that intersects an existing agricultural building. <br /> An agricultural building is a permitted use in the AG40 zone, and is consistent with <br /> the AIG (General Agriculture) General Plan. <br /> d. The cancellation will not result in discontiguous patterns of urban development. <br /> This subfinding can be made because this cancellation is only to move a property line <br /> around an existing agricultural building and will not result in any urban development. <br /> e. There is no proximate noncontracted land which is both available and suitable for the use <br /> which is proposed the contracted land be put, or, development of the contracted land would <br /> provide more contiguous patterns of urban development than development of proximate non- <br /> contracted land. <br /> This subfinding can be made because the agricultural building is existing, and a <br /> portion of the building is on property under contract. <br /> Cancellation Recommendation and Actions <br /> The Planning Commission will make a recommendation for approving or denying the request for <br /> cancellation. That recommendation will be forwarded to the Board of Supervisors. The Board of <br /> Supervisors will either deny the request or approve a tentative cancellation with conditions and -- <br /> contingencies. Before the Board can execute a final Certificate of Cancellation, the landowner must pay <br /> the cancellation fee and satisfy any additional conditions and or contingencies imposed by the Board. <br /> San Joaquin County PA-06005001Per MC LLC <br /> Community Development Page 4 <br /> 11 <br />
