There is no proximate noncontracted land which is both available and <br /> suitable for the use to which it is proposed the contracted land be put, or, <br /> development of the contracted land would provide more contiguous <br /> patterns of urban development than development of proximate <br /> noncontracted land. <br /> This subfinding can be made because the agricultural building is <br /> existing and a portion of the agricultural building is on property <br /> under contract. <br /> Because finding No..1 can be made in the affirmative, the Community <br /> Development Department intends to take this item to the Planning Commission <br /> with a recommendation of approval. <br /> Environmental Considerations <br /> The initial study prepared for this project on January 9, 2007 concluded that the <br /> proposed cancellation would not result in any significant environmental:impacts. <br /> Based on the initial study, a negative declaration was prepared and forwarded to <br /> the State Clearinghouse and Planning Unit for circulation. <br /> Cancellation Value and Cancellation Fees <br /> The County Assessor is responsible for computing a cancellation fee for the <br /> subject property based on 12 '/z percent of the current market value. The <br /> Assessors office has indicated that the computed fee will be available prior to <br /> April 1, 2007. <br /> 3 <br />
