1 <br /> Findings rt <br /> The Board of Supervisors,may,grant tentative`approVal for.cancellation.of a. <br /> contract on Vllilliamson'Act property only if it:makes one of the following findings: <br /> 1. That`the.cancellation.is consistent with the'-pur'po' ses 011ie Williamson- <br /> Act; or <br /> 2. That the cancellation is in the public.interest. <br /> Both of these findings include subfindings that the Board must also make. The <br /> following is an analysis of those findings: <br /> i 1. That the cancellation is consistent with the purposes of the Williamson <br /> Act <br /> a. The cancellation is for land on which a Notice of Nonrenewal has been <br /> served pursuant to Section 51245 of the Government Code. <br /> This subfinding can be made because the Community- <br /> Development Department approved a Notice of Nonrenewal on <br /> February 15, 2006. <br /> b. The cancellation is not likely to result in the removal of adjacent lands <br /> from agricultural use. <br /> This subfinding can be made because the property to the east of <br /> this site isnot under contract and only 4.458 acres of land is to <br /> come out of contract. <br /> " <br /> C. The cancellation is for an alternative use which is consistent with the <br /> applicable provisions of the County General Plan. <br /> This subfinding can be made because the cancellation is to <br /> facilitate a Lot Line Adjustment to move a property line that <br /> intersects an existing agricultural building. An agricultural <br /> building is a permitted use in the AG-40 zone, and is consistent <br /> it with the AIG (General Agriculture) General Plan. <br /> d. The cancellation will not result in discontiguous patterns of urban <br /> development. <br /> This sabfinding can be made because this cancellation is only to <br /> move a property line around an existing agricultural building and <br /> will not result in any urban development. <br /> 2 ° <br />
