CONDITIONS OF APPROVAL <br /> PA-0500249 <br /> San Joaquin County Hospital/Oxy Resources California <br /> Use Permit Application No. PA-0500249 was approved by the San Joaquin County Planning <br /> Commission on July 7, 2005. The effective date of approval is July 17, 2005. This approval will <br /> expire on January 16, 2007, which is 18 months from the effective date of approval, unless (1) all <br /> Conditions of Approval have been complied with, (2) all necessary building permits have been <br /> secured and remain in force, and (3) all necessary permits from other agencies have been secured <br /> and remain in force. <br /> Unless otherwise specified, all Conditions of Approval and Ordinance requirements shall be fulfilled <br /> prior to the establishment of the use and the issuance of any building permits. Those Conditions <br /> followed by a Section Number have been identified as Ordinance requirements pertinent to this <br /> application. Ordinance requirements cannot be modified, and other Ordinance requirements may <br /> apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT(Staff Contact: Kathy Allen, 953-7509) <br /> a. IMPROVEMENT PLAN: Submit an "APPLICATION-IMPROVEMENT PLAN." The Site Plan <br /> required as part of the Improvement Plan must be prepared by a registered civil engineer or <br /> licensed architect. This Plan must show drainage, driveway access details (including gates), on- <br /> site parking, landscaping, signs, all structures, equipment, sumps, access roads, existing and <br /> proposed utility services, and grading (refer to the "SITE PLAN CHECK LIST' for details). A fee <br /> is required for the Site Plan review. (Development Title Section 9-884) <br /> b. APPROVED USE: This approval is for a natural gas extraction facility. (Use Type: Petroleum <br /> and Gas Extraction), as shown on the Site Plan submitted April 22, 2005. <br /> c. PERMIT VOID: This permit shall be subject to the following: <br /> (1) Actual drilling shall be diligently pursued to completion, or the permit shall become void. <br /> (2) Any cessation for one-hundred-eighty (180) days or more shall void this permit. <br /> (3) The permit shall become void should the use of the property become a nuisance as defined <br /> by Section 9-3113 of the Development Title. <br /> d. SURETY BOND: There must be proof that the applicant has posted a surety bond as required by <br /> the State of California Division of Oil and Gas. The bond shall remain in force until drilling is <br /> completed and the site is restored. On completion or abandonment of the well, all sumps shall be <br /> filled to natural grade site and restored to its original condition. <br /> e. FENCING: Unattended sumps shall be enclosed by a six-foot (6) high chain-link fence. <br /> f. TRANSFERRAL: This permit may be transferred provided: <br /> (1) The transferee provides the Planning Division with proof of a surety bond, as required by the <br /> California Division of Oil and Gas, two weeks prior to the transfer. <br /> (2) The transferee complies with all conditions of the approved permit. <br /> Conditions of Approval - 1 - PA-0500249 <br />
