As it turned out we already have the
engineered design for the required system by a Civil Engineer. I see this as
purely another waste of money and more red tape. Since this project is dead it
is not an issue for debate.
Finally:
SJCOG letter undated:
Our land is a vineyard, 12 years ago we obtained a vernal pool delineation
and clearance from the NIZCS, and it was eventually accepted by the Corp of
Engineers and US Fish and Wildlife. The subject section of land, does not now
ever has had vernal pool habitat. We farm this land, and I disc and mow this
area every year, which I will continue to do so. I will not be hiring any
biologist not doing anything else laid out in their demand letter. Above all, this
element has ended this project. I spent one year in 1997 under threat of a cease
and desist order by Corp of Engineers, I nearly lost the ranch and all my
possessions could have been lost had the Corp won and stopped my right to
farm. Farm Bureau, and the Pacific Legal Foundation helped me when I could
not fund the legal battle. I will never subject myself to that again..
Historically, the real estate boom led.people to continue to attempt
projects even in the face of mounting regulatory cost on the promise of a big
payoff in a hot market. Those days are long gone. I have been burned on
several development projects over the years, where regulatory costs drven the
cost of projects so high that many years of losses resulted for the businesses. I
have learned my lesson. Here, aside from ruining the; very experience that I
believe my visitor wants to have in a rural area you will drive the cost of the
project well beyond its ability to ever produce a return for me and my family.
Unlike in 1997, where I was in a position where I had no choice but go ahead, I
have options now. I choose to do nothing with this. I believe San Joaquin
County is the real looser because I think the fees, taxes, and jobs and visitors
that would have come with this were likely more beneficial than any direct
benefit I would obtain. I sincerely regret not taking the $7,000 I have invested
in the process and going on vacation instead.
Sincere
Dave Pecharl
