Recommendations <br /> Action <br /> It is recommended that the Planning Commission: <br /> 1. Approve the Negative Declaration; and <br /> 2. Approve Use Permit No. PA-03-592 with the Findings and Conditions of Approval contained in <br /> the staff report. <br /> Findings <br /> 1. The proposed use is consistent with the goals, policies, standards, and maps of the General Plan, any <br /> applicable Master Plan, Specific Plan, and Special Purpose Plan, and any other applicable plan <br /> adopted by the County. <br /> • This Finding can be made because the proposed off-premises sign is consistent with all <br /> regulations of the Development Title and General Plan. The proposed sign will have a <br /> maximum face area of 672 square feet, will not exceed 48 feet in length, and will not be <br /> above grade by more than 45 feet. There are no Master Plans, Specific Plans, or Special <br /> Purpose Plans in the project area. Although the City of Manteca states in a letter dated <br /> December 10, 2003, that the sign does not conform to the city sign regulations and is not <br /> consistent with City of Manteca General Plan policy, the sign does meet all of the San <br /> Joaquin County General Plan policies and,therefore, may be approved. <br /> 2. Adequate utilities, roadway improvements, sanitation, water supply, drainage, and other necessary <br /> facilities have been provided, and the proposed improvements are properly related to existing and <br /> proposed roadways. <br /> • This finding can be made because the sign is required to be set back a minimum of five (5) <br /> feet from any future road right-of-ways, and the applicant will be required to obtain an <br /> Outdoor Advertising Display permit from the Department of Transportation prior to <br /> construction of the sign. In addition, any storm water run-off generated from the <br /> construction of the sign will need to be maintained on the site. <br /> 3. The site is physically suitable for the type of development and for the intensity of development. <br /> • This finding can be made because an off-premises sign may be conditionally permitted in <br /> the C-G (General Commercial) zone with an approved Site Approval. The sign shall be <br /> located a minimum of 1,000 feet from any other off-premises signs on either side of the <br /> street. <br /> 4. Issuance of the permit will not be significantly detrimental to the public health, safety, or welfare or be <br /> injurious to the property or improvements of adjacent properties. <br /> • This finding can be made because the sign will not significantly impact the public in regards <br /> to health, safety, of welfare.
