Second Unit Dwellings: Second unit dwellings shall be required on at least 10 percent of the <br /> parcels within the R-M zoning districts consistent with the preliminary second unit plan <br /> approved with the Tentative Map. The minimum number of second unit dwellings required for <br /> this subdivision within Specific Plan III shall be 27. [SPIII Implementation Measure 3.4.2.3(a); <br /> Master Plan Development Title Chapter 9-830M]. The Applicant shall place the following note <br /> on the applicable Final Maps for recordation: <br /> "Second unit dwellings shall be required on at least _lots of the Final Map consistent with the <br /> preliminary second unit plan approved with the tentative map and Chapter 9-830M of the San <br /> Joaquin County Development Title. The location of an approved second unit may be amended <br /> by Community Development Department only by designation of a replacement lot to receive the <br /> second unit. All replacement parcels must be located within Specific Plan III. Parcels for each <br /> residential subdivision within the R-M zoning districts shall be consistent with the preliminary <br /> second unit plan approved with the Tentative Map." <br /> Timing: Condition shall be met prior to recordation of each Final Map. <br /> 10. BBID Canal Conflicts: Fence off the two on-site BBID canals from proposed urban <br /> development until such time as the canals are filled.The fencing shall be sufficient to block <br /> access to the canals by all except BBID personnel and other authorized persons, and shall be <br /> developed in coordination with BBID to ensure that BBID has continued access to the canals <br /> for maintenance activities. Agricultural Conflicts: Before development,the project developers shall provide for the <br /> continued provision of irrigation water to downstream agriculture reliant on the water from the <br /> canals by the installation of pipelines and other means.The filling of the irrigation canals shall <br /> be approved by BBID. To the extent feasible, developers shall provide or secure a setback from <br /> development to existing agricultural operations of at least 100 feet. Occupancy permits shall <br /> not be issued for lots with less than a 40-foot setback from agricultural operations existing <br /> within a 12-month period prior to the time of final map approval. An exception to the <br /> requirement for a setback may be granted when the owner of such agricultural land has <br /> indicated in writing that the land will no longer be used for agricultural production. <br /> [Implementation Measure 3.2.4.3(d)] <br /> Timing: Improvement plans approved by CDD and MHCSD prior to Final Map approval. <br /> 13.
