c. A DFG Streambed Alteration Agreement and 401 Water Quality Certification may also be <br /> required for fill of the irrigation canals and the ephemeral (College)drainage. DFG shall <br /> be consulted to determine if a Streambed Alteration Agreement is required. If USACE <br /> does not take jurisdiction over the irrigation canals or drainages, the RWQCB shall be <br /> consulted to determine if a 401 Water Quality Certification is required. <br /> d. The acreage of waters of the United States that would be removed shall be replaced or <br /> restored/enhanced by the developers on a "no-net-loss" basis in accordance with USACE <br /> and DFG regulations. Habitat restoration, enhancement, or replacement shall be at a <br /> location and by methods agreeable to USACE and DFG, as determined during the CWA <br /> Section 404 and California Fish and Game Code Section 1602 permitting processes. <br /> [MM4.10-10] <br /> Timing: The applicant shall submit an approved report of pre-construction surveys to the San <br /> Joaquin County Community Development Department(CDD)prior to the issuance of grading <br /> permits for the project. <br /> 42. Biological Resources Efects from Offsite Infrastructure Improvements: <br /> San Joaquin Countv <br /> For those off-site improvements proposed in San Joaquin County, the College Park <br /> developers shall implement Mitigation Measures 4.10-5, 4.10-6,4.10-7, 4.10-9, and 4.10-10. <br /> Alameda County <br /> For those off-site improvements proposed in Alameda County, the College Park developers <br /> shall implement the measures identified below: <br /> Special-Status Plants <br /> a. Before any ground-disturbing or vegetation-clearing activities, a qualified botanist shall <br /> conduct surveys for the special-status plant species identified in Table 4.10-1 of the <br /> College Park Final EIR. Surveys shall be conducted at the appropriate time,when the <br /> target species would be in flower and therefore clearly identifiable(i.e., blooming period) <br /> and in all areas of suitable habitat that would potentially be disturbed. If no special-status <br /> plants are found, no further mitigation shall be required. <br /> b. If special-status plants are found and the populations can be avoided during project <br /> implementation, they shall be clearly marked in the field by a qualified botanist for <br /> avoidance during construction activities <br /> c. If special-status plant populations cannot be avoided, consultations with DFG and/or <br /> USFWS may be required, depending on the listing status of the species present. These <br /> consultations shall determine appropriate mitigation measures for any populations that <br /> would be affected by the implementation of the proposed project.Appropriate measures <br /> may include the creation of off-site populations through seed collection or transplanting, <br /> preservation and enhancement of existing populations, or restoration or creation of <br /> suitable habitat in sufficient quantities to compensate for the impact. <br /> California Red-Legged Frog <br /> a. Before project activity, USFWS shall be consulted to determine whether widening of <br /> Grant Line Road has potential to adversely affect California red-legged frog. It may be <br /> necessary to conduct a formal habitat assessment and surveys to make such a <br /> determination. If it is determined that adverse effects are unlikely to occur, no further <br /> mitigation shall be required. <br /> b. If it is determined that adverse effects to California red-legged frog could occur, <br /> consultation with USFWS shall be conducted, and authorization for incidental take could <br /> be required. Speck mitigation measures would be developed during the consultation <br /> process. Measures designed to avoid and minimize take to the greatest extent feasible <br /> shall be developed and implemented. These may include limiting activities to certain <br /> seasons, minimizing vegetation removal and in-water construction activities, conducting <br /> pre-construction surveys, and conducting daily surveys and monitoring of construction <br /> areas. If necessary, appropriate compensation for loss of habitat and other adverse <br /> 12 <br />
