II. MOUNTAIN HOUSE COMMUNITY SERVICE DISTRICT (Staff Contact: Nader <br /> Shareghi, 468-9997) <br /> GENERAL <br /> 1. All subdivision improvements including but not limited to subdivision improvement plans, <br /> specifications and master utility plans shall be in conformance with Community Approvals, <br /> including but not limited to the Improvement Standards and Specifications of the Mountain <br /> House Community Services District(MHCSD), the Design Manual, Master Plan, Specific <br /> Plan III, master utility plans, and other standards and plans adopted by the MHCSD. These <br /> improvement plans and specifications must be approved by the MHCSD prior to approval of <br /> each phased Final Map. The plan check fees shall be made with the submittal of the <br /> improvement plans and the field inspection services costs shall be made to the MHCSD prior <br /> to signing of the improvement plans. If the actual costs exceed the estimated costs, the <br /> developer shall pay the balance within 30 days upon receiving an Invoice from the MHCSD. <br /> 2. The developer shall comply with all requirements of State, Federal, SP III, SP III EIR, <br /> including but not limited to County, State and Federal requirements relative to air quality, <br /> storm water discharge,waste disposal and hazardous waste and the mitigation measures <br /> contained in the EIR for the Tentative Map. <br /> 3. All onsite and offsite easements and dedications shown on and proposed for the Tentative <br /> Map shall be dedicated to the MHCSD or offer of dedication to the MHCSD shall be recorded <br /> on the Final Map. Dedication of public rights-of-way shall be in conformance with the <br /> adopted Public Land Equity Program (PLEP). Any easements to be abandoned that belong <br /> to Byron Bethany Irrigation District(BBID)shall not be abandoned without prior approval of <br /> BBID.Timing: condition shall be met prior to approval of Final Map. <br /> 4. Prior to or upon filing of the first final map as determined by the MHCSD General Manager, <br /> all rights-of-ways necessary to provide utilities and access to all areas of Tract Number 3506 <br /> as shown on the Tentative map shall be dedicated to the MHCSD or offer of dedication shall <br /> be made to the MHCSD. <br /> 5. The applicant shall provide written proof that two points of access and utility easements can <br /> be provided to Tract Number 3506 from and through Tract 3480 prior to approval of the <br /> Tentative maps for Tracts Number 3480 and 3506. <br /> 6. All services performed by the MHCSD on any development project will be paid by the <br /> applicant at the full cost including overhead as determined by the MHCSD General Manager. <br /> The General Manager may set an interim fee as a deposit and reconcile to the final cost at <br /> least annually. <br /> 7. Except where provided otherwise in a Project Acquisition Agreement, prior to the recording of <br /> any Final Map, all infrastructure facilities outside the boundary of the Tentative Map (water, <br /> sewer, storm drainage, electric power, natural gas, telephone, communications, etc.) <br /> necessary to serve Tract 3506 shall be in place and fully operational. The MHCSD General <br /> Manager may defer the installation of a facility if it can be demonstrated to the satisfaction of <br /> the MHCSD General Manager that it is not required for the phase of Tract 3506 being <br /> developed. Any deferral will require the developer to provide the MHCSD a bond insuring the <br /> eventual construction of the facility. <br /> 8. All conditions on the"Will Serve" letter from the Mountain House Community Services District <br /> shall be met prior to approval of Final Map.The MHCSD General Manager may defer the <br /> installation of a facility if bonding is provided and it can be demonstrated to the satisfaction of <br /> the MHCSD General Manager that it is not required for the phase of Tract 3506 being <br /> developed. <br /> 17 <br />
