Maps shall be similarly modified to conform to the Speck Plan III as revised by court action. <br /> A Final Map shall not be filed with the County Surveyor until this Tentative Map is revised. <br /> 101. The fair share of TIF, CFF,TIMF, and other MHCSD fees shall be paid in full by, or on <br /> behalf, of Delta College prior to annexation of any territory in SP III to MHCSD. The time of <br /> payment shall be prior to the filing of a Certificate of Completion for the annexation by the <br /> San Joaquin Local Formation Commission. Delta College is not required to obtain a <br /> subdivision map, other land use approvals, or building permits. Because of these <br /> exemptions, developer shall not be permitted to file a Final Map with the County Surveyor <br /> until such time that Delta College's fair share of annexation fees, as determined by MHCSD, <br /> have been paid to MHCSD. <br /> III. COUNTY COUNSEL (Staff Contact: Zoey Merrill, 468-2980) <br /> 1. HOLD HARMLESS PROVISION: Pursuant to Section 66474.9 of the Government Code, the <br /> subdivider shall defend, indemnify, and hold harmless the local agency or its agents, officers, <br /> and employees from any claim, action,or proceeding against the local agency or its agents, <br /> officers,or employees to attack,set aside,void, or annul an approval of the local agency, <br /> advisory agency, appeal board, or legislative body concerning a subdivision,which action is <br /> brought within the time provided for in Section 66499.37 of the Government Code. <br /> Timing: Prior to recordation of the Final Map. <br /> IV. ENVIORNMENTAL HEALTH DEPARTMENT (Rodney Estrada 209-468-0331) <br /> The tentative map shall comply with the Speck Plan III in regards to public services and <br /> contaminated site mitigation issues. <br /> V. SAN JOAQUIN VALLEY UNIFIED AIR POLLUTION CONTROL <br /> DISTRICT(John Cadrett 209-557-6400) <br /> The developer shall comply with all requirements of the SJVUAPCD. <br /> Vl. Lammersville Elementary School District (Doris M. Unsod 209-836-7400, <br /> ext. 2314) <br /> 1. The developer shall enter into full mitigation agreements with the LESD, as defined, in <br /> part, by the Master Plan, prior to approval of any Final Map. <br /> 2. The School funding agreement between the applicant and Lammersville Elementary <br /> School District and the Tracy Unified School District shall be implemented to provide <br /> interim and permanent funding for school facilities, as evidenced by certificates of <br /> compliance from the jurisdiction stating that the developer has complied with funding <br /> requirements as per the agreements. The condition shall be met prior to approval of <br /> Final Maps. <br /> VII. Tracy Unified School District(Denise Wakefield, 209-830-3245) <br /> 1. The developer shall enter into full mitigation agreements with the Tracy Unified School <br /> District, as defined, in part, by the Master Plan, prior to approval of any Final Map. <br /> 2. The School funding agreement between the applicant and Lammersville Elementary <br /> School District and the Tracy Unified School District shall be implemented to provide <br /> 30 <br />
