II. MOUNTAIN HOUSE COMMUNITY SERVICE DISTRICT (Staff Contact, <br /> Gabriel Karam 209-831-5609) <br /> 1. GENERAL: <br /> A. All subdivision improvements including but not limited to subdivision improvement plans, <br /> specifications and master utility plans shall be in conformance with Community <br /> Approvals, including but not limited to the Improvement Standards and Specifications of <br /> the Mountain House Community Services District(MHCSD), the Design Manual, Master <br /> Plan, Specific Plan III, master utility plans, and other standards and plans adopted by the <br /> MHCSD. These improvement plans and specifications must be approved by the MHCSD <br /> prior to approval of each phased Final Map. The plan check fees shall be made with the <br /> submittal of the improvement plans and the Feld inspection services costs shall be made <br /> to the MHCSD prior to signing of the improvement plans. If the actual costs exceed the <br /> estimated costs, the developer shall pay the balance within 30 days upon receiving an <br /> Invoice from the MHCSD. <br /> B. All onsite and offsite easements and dedications including Mountain House Parkway, <br /> Grant Line Road and De Anza Boulevard rights-of-way and any public or private utility <br /> easements shall be dedicated to the MHCSD or offer of dedication to the MHCSD, as <br /> required by the MHCSD, shall be on the Final Map_ Dedication of Mountain House <br /> Parkway, Grant Line Road and De Anza Boulevard rights-of-way and other needed public <br /> rights-of-way shall be in conformance with the Master Plan, SP III,the MHCSD Design <br /> Manual and Standard Plans and Specifications and the adopted Public Land Equity <br /> Program (PLEP). Any easements to be abandoned that belong to Byron Bethany <br /> Irrigation District(BBID)shall not be abandoned without prior approval of BBID.Timing: <br /> condition shall be met prior to approval of Final Map. <br /> C. All services performed by the MHCSD on any development project will be paid by the <br /> applicant at the full cost including overhead as determined by the MHCSD General <br /> Manager. The General Manager may set an interim fee as a deposit and reconcile to the <br /> final cost at least annually. <br /> D. All reference to approvals herein by the MHCSD shall be interpreted as approval by the <br /> General Manager or his designee except for those approvals specifically delegated by <br /> law to the Board of Directors. <br /> E. All references to bonding shall mean a bond or any other security acceptable to MHCSD. <br /> F. All public lands shown on the tentative map shall be dedicated or offered for dedication to <br /> MHCSD at the time of approval of the Final Map in accordance with the PLEP Ordinance, <br /> if applicable. Dedications shall also include DeAnza Boulevard right-of-way within the <br /> subdivision boundary in accordance with the Master Plan, SP III, the MHCSD Design <br /> Manual and Standard Plans and Specifications. <br /> 2. Final Mao Digital File: A digital file of the Final Map shall be submitted to the MHCSD and <br /> to the Community Development Department. The digital file format shall be consistent with <br /> requirements of the County Assessor and Community Development Department GIS division <br /> and the MHCSD digital file format. Condition shall be met prior to approval of Final Map. <br /> 3. Hold Harmless Provision: The subdivider shall defend, indemnify, and hold harmless the <br /> MHCSD, its agents, officers, and employees,from any claim, action, or proceeding against <br /> the MHCSD, its agents, officers, or employees, to attack, set aside,void, or annul an <br /> approval of MHCSD concerning any MHCSD condition,which action is brought within the <br /> time provided for in Section 66499.37 of the Government Code. <br /> 39 <br />
