III. COUNTY COUNSEL <br /> 1. HOLD HARMLESS PROVISION: Pursuant to Section 66474.9 of the Government Code,the <br /> subdivider shall defend, indemnify, and hold harmless the local agency or its agents, officers, <br /> and employees from any claim, action, or proceeding against the local agency or its agents, <br /> officers, or employees to attack, set aside, void, or annul an approval of the local agency, <br /> advisory agency, appeal board, or legislative body concerning a subdivision, which action is <br /> brought within the time provided for in Section 66499.37 of the Government Code. <br /> IV. In order to participate in the San Joaquin Multi-Species Habitat Conservation and Open <br /> Space Plan(SJMSCP), the developer shall complete the following steps to satisfy SJMSCP <br /> requirements: <br /> a) Contact the San Joaquin Council of Governments(SJCOG)to schedule a SJMSCP <br /> Biologist to perform a pre-construction survey prior to any ground disturbance. <br /> b) Sign and return to SJMSCP staff of SJCOG the Incidental Take Minimization Measures <br /> (given to the developer by SJMSCP staff after the pre-construction has been completed). <br /> c) Pay to SJCOG the-SJMSCP fee based on SJMSCP findings. <br /> d) Upon paying the SJMSCP fee, receive from SJMSCP staff the Certificate of Payment. <br /> VI. An Indirect Source Review application shall be submitted prior to or concurrent with the final <br /> discretionary application with San Joaquin County. <br /> VII. Refuse, garbage and other solid waste material must be removed and transported to an <br /> approved disposal facility in accordance with San Joaquin County Ordinance Code Section <br /> 5-2400. <br /> Note: Provide Environmental Health Department receipt of removed solid waste materials <br /> before recordation of the final map. <br /> 40 <br />
