Implementation of this mitigation measure would reduce the impact to special- <br /> status nesting bird habitat to a less-than-significant level. <br /> LMitigation Measure 4.10-9 requires Specific Plan III developers to pay impact fees to the <br /> SJMSCP and presents specific measures for locating and protecting kit fox dens until they are <br /> vacant. Implementation of this mitigation measure would reduce the impact on habitat <br /> I. conversion of the San Joaquin kit fox to a less-than-significant level. <br /> Mitigation Measure 4.10-10 requires Specific Plan III developers to engage a biologist to <br /> 6. delineate potential waters of the United States at the project sites, including any wetlands, <br /> ponds, irrigation canals,and drainage courses. If such waters exist and would be filled in, <br /> authorization for the fills shall be secured from the United States Army Corps of Engineers <br /> L via the Section 404 permitting process. Stream Bed Alteration Agreements from the <br /> California Department of Fish and Game and Section 401 Water Quality Certifications from <br /> the San Joaquin Valley Regional Water Quality Control Board may also be required. <br /> L Implementation of this mitigation measure would reduce the impact on waters of the United <br /> States to a less-than-significant level. <br /> DISCUSSION REGARDING PROPOSED PROJECT <br /> L a) Have a substantial adverse effect, either directly or through habitat modifications, on <br /> any species identified as a candidate, sensitive, or special status species in local or <br /> regional plans,policies, or regulations, or by the California Department of Fish and <br /> Game or U.S. Fish and Wildlife Service? <br /> L <br /> The proposed Machado property project would eliminate potential foraging or limit potential <br /> nest habitat for nest raptors such as the Swainson's hawk,burrowing owl,or other raptor <br /> L species of concern. The MEIR includes Mitigation Measures M4.11-2, M4.11-3 and M4.11- <br /> 4(b) to address these potential impacts. In addition, the SPIIIEIR includes mitigation <br /> measures that are discussed above. Mitigation measures for potential impacts on sensitive <br /> 6. species proposed in the MEIR and the SPIIIEIR make the impacts less than significant. <br /> Mitigation Measures <br /> No additional mitigation measures are required. <br /> L <br /> b) Have a substantial adverse effect on any riparian habitat or other sensitive natural <br /> community identified in local or regional plans,policies, regulations, or by the <br /> California Department of Fish and Game or U.S. Fish and Wildlife Service? <br /> L <br /> There are no apparent riparian habitats within the project site. The dairy ponds and the BBID <br /> Canal 120 are man-made, excavated improvements that appear to be hydrologically isolated <br /> L from natural drainages or jurisdictional waters of the United States. The California Natural <br /> Diversity Database records for the United States Geologic Survey 7.5 minute Clifton Court <br /> Forebay topographic quadrangle map lists the Valley Sink Scrub,Northern Claypan Vernal <br /> VPool and Alkali Meadow habitats as present within the map area.
