Mr. Martin May 1, eJ06 <br /> Global Investment Page 6 <br /> Based on the information provided, the proposed project will also be subject to the following District rules. <br /> The following items are rules that have been adopted by the District to reduce emissions throughout the <br /> San Joaquin Valley, and are required. This project may be subject to additional District Rules not <br /> enumerated below. To identify additional rules or regulations that apply to this project, or for further <br /> information, the applicant is strongly encouraged to contact the District's Small Business Assistance Office <br /> at(209)557-6446. Current District rules can be found at http://www.valleyair.org/r-ules/1 ruleslist htm. <br /> Adhering to the requirements of District rules should be considered compliance rather than mitigation. <br /> Mitigation is those measures taken to lower emissions above and beyond what is required by compliance <br /> with District rules. The District believes this distinction is important because mitigation measures will <br /> require the preparation of a mitigation monitoring program that provides the schedule for implementation <br /> and the enforcement mechanism. In future documents, the District recommends that compliance with <br /> District rules should be stated separately in the air quality discussion as part of the project. <br /> Regulation Vlll (Fugitive PM10 Prohibitions) Rules 8011.8081 are designed to reduce PM10 <br /> emissions (predominantly dust/dirt) generated by human activity, including construction and <br /> demolition activities, road construction, bulk materials storage, paved and unpaved roads, carryout <br /> and trackout, landfill operations, etc. The District's compliance assistance bulletin for construction <br /> sites can be found at http•//www valleyair orq/busind/comply/PM10/Req%20VI11%20CA6 pdf. <br /> If a residential project is 10.0 or more acres in area, or a non-residential project is 5.0 or more acres in <br /> area, or the project will include moving, depositing, or relocating more than 2,500 cubic yards per day <br /> of bulk materials on at least three days, a Dust Control Plan must be submitted as specified in Section <br /> 6.3.1 of Rule 8021. Construction activities shall not commence until the District has approved the <br /> Dust Control Plan. A template of the District's Dust Control Plan is available at <br /> http://www.valleyair orq/busind/comply/PM10/forms/DCP-Form°/u20 %2012-01 2005 doc. <br /> Rule 3135 (Dust Control Plan Fee) This rule requires the applicant to submit a fee in addition to a <br /> Dust Control Plan. The purpose of this fee is to recover the District's cost for reviewing these plans <br /> and conducting compliance inspections. More information on the fee is available at <br /> hftp://www.vallMir.om/ruies/currntruies/Rule%203135%201005.pd . <br /> Rule 3180 (Administrative Fees for Indirect Source Review)This rule requires the applicant to submit <br /> a fee in addition to an Indirect Source Review Application. The purpose of this fee is to recover the <br /> District's cost for the review and management of these applications. More information on the fee is <br /> available on the District website at http://www.vallevair.org/rules/currntruies/Rule 3180 1205 pdf. <br /> Rule 4002 (National Emission Standards for Hazardous Air Pollutants) In the event that any portion of <br /> an existing building will be renovated, partially demolished or removed, the project will be subject to <br /> District Rule 4002. Prior to any demolition activity, an asbestos survey of existing structures on the <br /> project site may be required to identify the presence of any asbestos containing building material <br /> (ACBM). Any identified ACBM having the potential for disturbance must be removed by a certified <br /> asbestos contractor in accordance with CAL-OSHA requirements. The District's Asbestos Requirements Bulletin can be found <br /> online at hftp://valleyair.org/busind/comply/asbestosbultn.htm. <br /> Rule 4101 (Visible Emissions) This rule prohibits emissions of visible air contaminants to the <br /> atmosphere and applies to any source operation that emits or may emit air contaminants. The <br /> applicant must contact the District's Small Business Assistance Office at (209) 557-6446 to receive <br /> additional information/instructions. <br /> Rule 4102 (Nuisance) This rule applies to any source operation that emits or may emit air <br /> contaminants or other materials. In the event that the project or construction of the project creates a <br /> public nuisance, it could be in violation and be subject to District enforcement action. <br />
