Mr.Martin May 1, 2006 <br /> ' <br /> Global Investment Page 3 <br /> Rule 4601 (Architectural Coatings) This rule limits volatile organic compounds from architectural <br /> coatings by specifying architectural coatings storage, clean up and labeling requirements. <br /> Rule 4641 (Cutback, Slow Cure, and Emulsified Asphalt, Paving and Maintenance Operations) If <br /> asphalt paving will be used, then paving operations of this project will be subject to Rule 4641. This <br /> rule applies to the manufacture and use of cutback asphalt, slow cure asphalt and emulsified asphalt <br /> for paving and maintenance operations. <br /> Rule 4901 (Wood Burning Fireplaces and Wood Burning Heaters) This rule limits PM10 and PM2.5 <br /> emissions from residential development. Construction plans for residential developments may be <br /> affected by section 5.3, specifically: <br /> §5.3 Limitations on Wood Burning Fireplaces or Wood Burning Heaters in New Residential <br /> Developments. <br /> Beginning January 1, 2004, <br /> 5.3.1 No person shall install a wood burning fireplace in a new residential development <br /> with a density greater than two(2)dwelling units per acre. <br /> 5.3.2 No person shall install more than two (2) EPA Phase II Certified wood burning <br /> heaters per acre in any new residential development with a density equal to or <br /> greater than three(3)dwelling units per acre. <br /> 5.3.3 No person shall install more than one (1) wood burning fireplace or wood burning <br /> heater per dwelling unit in any new residential development with a density equal to <br /> or less than two(2)dwelling units per acre. <br /> More information about Rule 4901 can be found on our website at www.vallevair.oro. For <br /> compliance assistance, please contact Mr. Wayne Clarke, Air Quality Compliance Manager, at <br /> (559)230-5968. <br /> Rule 4902 (Residential Water Heaters) This rule applies to and limits emissions of NOx from <br /> residential natural gas-fired water heaters. <br /> Rule 9510 (Indirect Source Review) This rule was adopted to reduce the impacts of growth in <br /> emissions from all new development in the San Joaquin Valley. Rule 9510 requires applicants subject <br /> to the rule to provide information that enables the District to quantify construction, area and <br /> operational PM10 and NOx emissions, and potentially mitigate a portion of those emissions. An <br /> application must be filed with the District no later than concurrent with application with a local agency <br /> for the final discretionary approval. For more information and instruction, please contact the District's <br /> ISR staff by phone at(559)230-5800 or by email at ISRno vallevair.oro. <br /> This project may be subject to District permitting requirements. The specific uses for the commercial and <br /> industrial areas are not identified. Future tenants may be subject to District permitting requirements. <br /> Depending on the nature and complexity of the application and staff workload, permitting approval may <br /> take several months. To avoid unnecessary delays, applications should be submitted to the District as <br /> soon as the project developer has determined the scope and speck uses of the building. For further <br /> information or assistance regarding permitting, you may contact the District's Small Business Assistance <br /> Office at(209) 557-6446. <br /> Rule 2010 (Permits Required) This rule requires any person constructing, altering, replacing or <br /> operating any source operation, which emits, may emit, or may reduce emissions to obtain an <br /> Authority to Construct or a Permit to Operate. <br /> Rule 2201 (New and Modified Stationary Source Review Rule) This rule applies to all new stationary <br /> sources and all modifications of existing stationary sources that are subject to the District permit <br /> requirements and after construction emit or may emit one or more affected pollutant. The applicant <br /> must contact the District's Small Business Assistance Office at (209) 557-6446 to receive additional <br /> inform ation/instructions. <br />
