CONDITIONS OF APPROVAL <br /> PA-0900124(MS) <br /> POLK/SANGUINETTI <br /> Minor Subdivision Application No. PA-0900124 was approved by the Community Development <br /> Department on June 18, 2013. The effective date of approval is June 28, 2013. This tentative map <br /> approval will expire on June 27, 2016, which is three (3) years from the effective date of approval, <br /> unless (1) all Conditions of Approval have been complied with and (2) a Parcel Map has been filed <br /> with and accepted by the County Surveyor. <br /> Unless otherwise specified, all Conditions of Approval and ordinance requirements shall be fulfilled <br /> prior to approval of the Parcel Map. Those Conditions followed by a Section Number have been <br /> identified as ordinance requirements pertinent to this application. Ordinance requirements cannot be <br /> modified and other ordinance requirements may apply. <br /> 1) COMMUNITY DEVELOPMENT DEPARTMENT (Staff Contact: John Funderburg,209-468-3160) <br /> a) TENTATIVE MAP: The Parcel Map shall substantially conform with the approved Revised Tentative <br /> Map dated February 28, 2013. <br /> b) RIGHT TO FARM: Pursuant to San Joaquin County Code Section 6-9004(b), the following note <br /> shall be placed on the Parcel Map and recorded as a separate instrument: <br /> (1) All persons purchasing parcels within the boundaries of this approved map should be <br /> prepared to accept the inconveniences or discomforts associated with agricultural operations <br /> or activities, such as noise, odors, insects, dust or fumes. San Joaquin County has <br /> determined that such inconveniencies or discomforts shall not be considered to be a <br /> nuisance. <br /> c) NOTICE OF NON-RENEWAL: A Notice of Non-renewal for Parcel Two will be required in <br /> conjunction with the Williamson Act Contract. A fee for the recording of the Notice of Non-renewal is <br /> required. <br /> d) TRANSFER RESTRICTION: A Note shall be placed on the Parcel Map and a Notice of Minor <br /> Subdivision Restriction shall be recorded concurrently with the Parcel Map, with a reference to the <br /> instrument number of said recorded notice, stating that: <br /> (1) Parcel Two shall not be transferred until June 18, 2023, or upon the death of an owner <br /> owning at least fifty (50) percent interest in the homesite parcel, unless the homesite parcel <br /> and the remainder parcel are merged pursuant to the provisions of the Development Title. <br /> (2) The property shown on the Parcel Map is restricted from further subdivisions for <br /> homesite purposes, except for financing only, by Section 9-610.3 of the San <br /> Joaquin County Development Title. <br /> e) TRANSFER RESTRICTION/MERGER/NONBUILDABLE REMAINDER: A Note shall be placed on <br /> the Parcel Map and a Notice of Minor Subdivision Restriction shall be recorded concurrently with the <br /> Parcel Map, with a reference to the instrument number of said recorded notice, stating that: <br /> (1) Neither 'Parcel One"or"Parcel Three" may be voluntarily transferred <br /> separately from the other parcel; however, if an institutional lender forecloses on either <br /> parcel, either parcel may be transferred separately in accordance with the power of sale <br /> provisions contained in the deed of trust. <br />
