(2) Upon repayment of the loan, the owner of"Parcel Three" shall merge the parcel with "Parcel <br /> One', as provided for in the Development Title, unless the owner of the homesite parcel <br /> acquired the homesite parcel through a foreclosure action, or unless the owner refinances <br /> the loan. <br /> (3) "Parcel One'shall remain a non-buildable site for primary dwelling units. <br /> (4) The above restrictions shall terminate if the subject property is reclassified to a non- <br /> agricultural zone or to an agricultural zone with a five (5) acre minimum. <br /> f) ACCESS: The following access requirements apply and shall be shown on the Parcel Map: <br /> (1) The following note shall be placed on the Parcel Map and also shall be recorded as a <br /> separate instrument: <br /> (a) At the time of non-agricultural development of Parcel Two, the entire length of the <br /> private right-of-way for Parcel Two shall be constructed and maintained to the standards <br /> required by the California Fire Code and applicable San Joaquin County Improvement <br /> Standards. (Development Title Section 9-1150.15[c]) <br /> g) LOT SIZE AND WIDTH: The following lot size and width regulations shall apply to this map: <br /> (1) Parcel One and Parcel Two shall have a minimum lot width of 150 feet. SD-96-0051 The "Notice of <br /> Second unit Dwelling" for Application No. SD-96-0051 shall be applied for and approved prior to <br /> the recordation of the Parcel Map for application number PA-0900124. <br /> i) PROPERTY LINE SETBACK: (The following requirements shall apply) <br /> (1) The proposed new side and rear property lines for Parcel Three shall meet the side and <br /> rear yard setback requirements for the AG-40 zoning designation (General Agriculture. <br /> 40-acre minimum) for non-agricultural and agricultural structures. (Development Title <br /> Section 9-610.2) <br /> j) COUNTY COUNSEL <br /> (1) HOLD HARMLESS PROVISION: Pursuant to Section 66474.9 of the Government Code, <br /> the subdivider shall defend, indemnify, and hold harmless the local agency or its agents, <br /> officers, and employees from any claim, action, or proceeding against the local agency or its <br /> agents, officers, or employees to attack, set aside, void, or annul an approval of the local <br /> agency, advisory agency, appeal board, or legislative body concerning a subdivision, which <br /> action is brought within the time provided for in Section 66499.37 of the Government Code. <br /> 2) ENVIRONMENTAL HEALTH DEPARTMENT (Contact Staff: Michael F.
