AGREEMENT <br /> Section 1: Owner agrees to convey the real property described in Exhibit A,attached hereto, <br /> to Grantee, subject to the requisite subdivision approvals pursuant to the San <br /> Joaquin County Ordinance. <br /> Section 2: Grantee agrees as follows: <br /> (a) To provide information and documents to the County of San Joaquin, as may be <br /> required by said County,to confirm and verify that Grantee is an immediate <br /> family member of Owner. <br /> Section 3: Owner and Grantee mutually agree as follows: <br /> (a) The subject property may not be transferred to anyone other than an immediate <br /> family member as defined in Government Code Section 51230.1 so long as the <br /> subject property is subject to the Williamson Act Contract. Grantee shall not <br /> transfer this agreement to an immediate family member without the written <br /> consent of San Joaquin County; <br /> (b) If either party fails to comply with the terms herein,the County of San Joaquin <br /> may commence an action in the Superior Court of the State of California to <br /> enforce the provisions of this Agreement and/or may commence proceedings to <br /> terminate the Williamson Act Contract by issuing a notice of non-renewal. <br /> (c) That either party may enforce the provisions of this Agreement in accordance <br /> with the applicable remedies at law. <br /> Section 4: Term of Agreement: This Agreement shall continue in full force and effect so <br /> long as the above-referenced Williamson Act Contract remains in effect. <br /> Section 5: Covenants to Run With the Land: The provisions of this Agreement will be <br /> binding on the heirs,transferees and successors in interest of both Owner and <br /> Grantee. <br />
