CONDITIONS OF APPROVAL <br /> UP-93-12 <br /> Duane Bechthold <br /> Unless otherwise specified,all Conditions of Approval and Ordinance Requirements must be fulfilled <br /> prior to the establishment of trQ use and the issuance of any building permits. <br /> This approval will expire 18 months from the date of approval unless (1) all Conditions of Approval <br /> have been compiled with, (2) all necessary building permits have been secured and remain in force, <br /> and (3) all necessary permits from other agencies have been secured and remain in force. <br /> Those Conditions followed by a Section Number or other Statutory Requirement are based on <br /> Ordinance Requirements. Ordinance Requirements cannot be modified. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT: <br /> a. Only seven horses are permitted on the property at one time. (Development Title Section <br /> 9-1045.5) <br /> b. The front gate shall be open during business hours or shall be set back a minimum of <br /> 30 feet from the front property line. (Development Title Section 9-610.2) <br /> C. Parallel to Bear Creek, a natural open space for riparian habitat and waterway protection <br /> shall be maintained to provide nesting and foraging habitat and the protection of <br /> waterway quality. The minimum width of said open space shall be 100 feet, measured <br /> from the mean high water level of the natural bank or 50 feet back from the existing <br /> riparian habitat, whichever is greater. Water-dependent uses may be permitted in this <br /> buffer. <br /> The mean high water level and the edge of the riparian habitat shall be shown on the <br /> Improvement Plan. The open space buffer required above shall be shown on the <br /> Improvement Plan with the following note: <br /> • Pursuant to Section 9-1510.5 of the San Joaquin County Development Title, this <br /> area is designated as a natural open space for riparian habitat and waterway <br /> protection. No development other than water dependent uses shall be permitted <br /> in this space. <br /> d. Fences, corrals, and other structures are not permitted in the open space buffer. <br /> (Development Title Section 9-1510.5) <br /> e. Except for movement on and off the property, animals shall not be kept or maintained in <br /> coops, pens, corrals, barns, or similar structures closer than 40 feet from the rear or side <br /> property line. (Development Title Section 9-1045.5) <br /> f. Submit a Site Improvement Plan, prepared by a registered Civil Engineer, showing <br /> drainage, driveway access details, on-site parking, existing and proposed utility services, <br /> and grading. Storm drainage runoff shall be retained on the site. The drainage pattern <br /> and corresponding storm drain improvements shall be shown on the Improvement Plan. <br /> Conditions of Approval - 1 - UP-93-12 <br />
