CONDITIONS OF APPROVAL E. & R. MERTZ ET AL MS-91-41 Unless otherwise specified, all Conditions of Approval shall be complied with prior to the approval of the Parcel Map. 1. DEVELOPMENT SERVICES Conditions of Approval: a. Native oak trees that are removed from the site shall be replaced at the following rates: One ten-gallon tree for each tree removed which measures six or fewer inches in diameter. ° Three ten-gallon trees for each tree removed which measures more than six inches and less than 32 inches in diameter. ° Five ten-gallon trees for each tree removed which measures 32 or more inches in diameter. Replacement trees shall be of healthy commercial stock of the same species as those which are being removed, and they shall be planted on the same site, unless otherwise approved by the Community Development Director. b. The oak tree canopy along Jahant Slough shall be delineated on the parcel map. The following requirements shall apply to all oak trees in this area. These requirements shall also be recorded with the property description in the deed. 1. Permanent paving and soil compaction shall be minimized within the tree ' s dripline, no lawn or plants shall be planted within a ten-foot radius of the trunk of any native oak tree, and no flood irrigation systems shall be installed within the tree' s dripline. 2 . No grade changes greater than twelve (12) inches shall be permitted within the protected zone of any native oak tree, and no grade changes greater than six (6) inches shall be permitted within six feet of the tree ' s trunk. 3 . A minimum five-foot-high protective fence shall be installed at the edge of any native oak tree' s protected zone prior to any commencement of on-site construction. 4 . No construction shall be permitted within the protected
