Conditions Use Permit Application No. UP-97-17 was approved by the San Joaquin County Planning Commission on . The effective date of approval is . This approval will expire on _, which is six months from the effective date of approval, unless (1) all Conditions of Approval have been complied with, (2) all necessary building permits have been secured and remain in force, and (3) all necessary permits from other agencies have been secured and remain in force. Unless otherwise specified, all Conditions of Approval and Ordinance requirements shall be fulfilled prior to the establishment of the use and the issuance of any building permits. Those Conditions followed by a Section Number have been identified as Ordinance requirements pertinent to this application. Ordinance requirements cannot be modified, and other Ordinance requirements may apply. 1. COMMUNITY DEVELOPMENT DEPARTMENT: (Staff Contact: Kerry Sullivan, 468-3140) a. IMPROVEMENT PLAN: Submit an Improvement Plan. The Improvement Plan must be prepared by a registered civil engineer or licensed architect. This Plan must show drainage, driveway access details (including gates), on-site parking, landscaping, signs, existing and proposed utility services, and grading (refer to the "Site Plan Check List" for details). A fee is required for the Improvement Plan review. (Development Title Section 9-884) b. APPROVED USE: This approval is for a commercial stable to board and train 32 horses as shown on the Plan submitted December 8, 1997. The limit of 32 horses does not apply to the pasture. c. BUSINESS LICENSE: The applicant shall secure an approved Business License prior to the initiation of the use. The Business License may be applied for concurrently with the Improvement Plan application. (Section 7-1000 of the County Ordinance Code) d. ANIMAL REGULATIONS: The following animal regulations apply and shall be provided: (1) All animal enclosures, including but not limited to pens, cages, and feed areas, shall be maintained free from litter, garbage, and excessive accumulation of manure to discourage the proliferation of flies, other disease vectors, and offensive odors. The premises shall be maintained in a neat and sanitary manner. (Development Title Section 9-1045.7[b]) (2) Except for movement on and off the property, animals shall not be kept or maintained in coops, pens, corrals, or within barns or similar structures on property of less than '/z acre, closer than 40 feet from any rear or side property line.
