CONDITIONS OF APPROVAL <br /> PA-03-203 <br /> Clements Hills Vineyard Properties <br /> Minor Subdivision Application No. PA-03-203 was approved by the San Joaquin County Community <br /> Development Department on June 27, 2003. The effective date of approval is July 7, 2003. This <br /> tentative map approval will expire on July 6, 2006, which is three years from the effective date of <br /> approval, unless (1) all Conditions of Approval have been complied with and (2) a Parcel Map has <br /> been filed with and accepted by the County Surveyor. <br /> Unless otherwise specified, all Conditions of Approval and Ordinance requirements shall be fulfilled <br /> prior to approval of the Parcel Map. Those Conditions followed by a Section Number have been <br /> identified as Ordinance requirements pertinent to this application. Ordinance requirements cannot <br /> be modified, and other Ordinance requirements may apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT (Staff Contact: Leanne Mueller, 468-3228) <br /> a. TENTATIVE MAP: The parcel map shall substantially conform with the approved tentative map <br /> dated April 30, 2003. <br /> b. LOT SIZE AND WIDTH: The following lot size and width regulations shall apply to this map: <br /> (1) All parcels shall have a minimum lot area of 40 acres. (Development Title Section 9-610.2) <br /> c. ACCESS: The following access requirements apply and shall be shown on the Parcel Map: <br /> (1) A proposed 25-foot-wide private easement for access to Parcels 2, 3, and 4, along Parcel 1, <br /> shall be shown on the Parcel Map. (Development Title Section 9-1150.15) <br /> (2) The following note shall be placed on the Parcel Map and also shall be recorded as a separate <br /> instrument: <br /> A. At the time of development, the entire length of the private right-of-way shall be constructed <br /> to the parcel being developed, and it shall be maintained to the standards required by <br /> Section 10.207 of the Uniform Fire Code and applicable San Joaquin County Improvement <br /> Standards. (Development Title Section 9-1150.15[c]) <br /> d. WILLIAMSON ACT CONTRACT: An application for a California Land Conservation Contract (also <br /> known as the Williamson Act) shall be filed prior to approval of the Parcel Map. Legal descriptions <br /> reflecting the new parcel configurations shall be submitted with the application. Filing fees are <br /> required for this application. <br /> e. TREE PRESERVATION: Future development on the parcel(s) shall be consistent with the <br /> requirements of the County's Tree Preservation Ordinance (Development Title Section 9-1505.2). <br /> f. RIPARIAN HABITAT: Parallel to Bear Creek, a natural open space area for riparian habitat and <br /> waterway protection shall be maintained to provide nesting and foraging habitat and the <br /> protection of waterway quality. The minimum width of said open space shall be one-hundred <br /> (100) feet, measured from the mean high water level of the natural bank or fifty (50) feet back <br /> from the existing riparian habitat, whichever is greater. Water-dependent uses may be permitted <br /> in this buffer. The mean high water level and the edge of the riparian habitat shall be shown on <br /> the Site Plan. The open space buffer required above shall be shown on the Site Plans with the <br /> Conditions of Approval - 1 - PA-03-203 <br />
