May 14 09 10:45a SJC Community Development 2094683127 p.2 <br /> CONDITION'S OF APPROVAL <br /> Unless otherwise specified, the approved use shall not be <br /> established nor building permits issued until the applicant has <br /> fulfilled all Conditions of Approval . <br /> 1 . Planning Division: <br /> a. The sandbar--skimming portion of the project shall be <br /> completed within give years of the comniencement of opera- <br /> tions . The on-going yearly maintenance skimming to main- <br /> tain the site reclamation shall be permitted for 15 years <br /> thereafter _ Ir the excavation does not commence within 18 <br /> months after the date of approval, the permit is ter- <br /> minated . The applicant shall notify the Planning Division <br /> in writing when the sandbar-skimming operations begin. <br /> b. A performance guarantee is required to ensure site rehabi- <br /> litation and compliance with Conditions of Approval . The <br /> amount of the guarantee is and will be fully in force for <br /> any phase which is being excavated . The estimated cost of <br /> rehabilitating each phase mus:. be reviewed by the <br /> Department of Public works and the McMullin Reclamation <br /> District No . 2075 . The type of financial guarantee pro- <br /> posed by the applicant under this Section must be found <br /> acceptable by County Counsel prior to the public hearing <br /> on the permit. The type of financial guarantee may be, <br /> but is not limited to, the following: <br /> ( 1) A faithful performance bond . <br /> ( 2) A property escrow or escrow account. <br /> ( 3) A trust fund. <br /> c. Prior to commencement of operations, a revegetation plan <br /> shall be approved by the Department of Fish and Game. A <br /> copy of this approved plan shall be submitted to the <br /> Planning Division. <br /> 2 . State Department of Fish and Game <br /> a. The ni:•e acres to be revegetated will be identified within <br /> the area shown on the Land Use map. <br /> b . A revegetation plan shall be developed and submitted to <br /> the Department of Fish and Game for approval within 90 <br /> days . The plan shall include the planting schedule , spe- <br /> cies , densities , and maintenance. <br /> c . An easement or deed restriction will be placed over the <br /> approximately nine acres of existing riparian vegetation. <br /> QX-89-3 (ALEGRE ) -2- RES #90-301 <br />
