P <br /> Analysis <br /> On December 21, 1989, the Planning Commission approved Quarry Excavation permit NO.QX-89-0003 to <br /> permit the excavation_of 100,000 cubic yards of sand per year over a period of five (5)years and to annually <br /> re-grade the river sandbar for 15 years to maintain the stable condition of the sandbar <br /> On December 29, 1989, an appeal of the Planning Commission's actions was filed by the McMullin <br /> Reclamation District No. 2075. The bases for the appeal were the following issues: (1) potential for <br /> weakening of the levees, (2) potential of erosion and sedimentation to occur, (3) changes in the river. <br /> On February 20, 1990, the Board of Supervisors adopted Board Order No.90-311 which denied the appeal <br /> by the McMullin Reclamation District No. 2075 and approved Quarry Excavation permit No.Qx-89-0003 to <br /> permit the excavatiomof 100,000 cubic yards of sand per year over a period of five (5)years and to annually <br /> re-grade the river sandbar for 15 years, for a total project life of 20 years, to maintain the stable condition of <br /> the sandbar. The scheduled expiration date for the quarry excavation permit is February 20, 2010. <br /> On April 1, 2009, the;applicant submitted a Revisions of Approved Actions application to amend Community <br /> Development Department Condition No. 1.a. to extend the quarry excavation permit an additional twenty <br /> (20)years with a new expiration date of February 20, 2030. The amended request is the continued <br /> stabilization of the sandbar along the river and the ongoing prevention of levee erosion. <br /> The request for a Rev isions of Approved Actions v ill not change any of the previously approved conditions <br /> of approval or the approved Reclamation Plan. However, should the request for the Revisions of Approved <br /> Actions be denied, the applicant shall be required to begin reclamation activities as required by <br /> Development Title Section 9-1415.3(1)(0), which requires reclamation shall be completed within two (2) <br /> years from the commencement of the reclamation process. <br /> Reclamation District:2075 <br /> The Community Development Department received one letter of opposition from Reclamation District No, <br /> 2075. The central issue as indicated by the opposition is the removal of more sand may impact the river <br /> course and flow as well as impact the neighbors' ability to pump water to their ranch. <br /> The quarry excavation'permit was approved by the Board of Supervisors to permit the excavation of <br /> 100,000 cubic yards f sand per year over a period of five (5) years and to annually re-grade the river <br /> o <br /> sandbar for 15 years,o maintain the stable condition of the sandbar. The project has been,,inspected <br /> annually by the Country as required by the Surface Mining and Reclamation Act(SMARA). The last <br /> inspection was conduirted by the County on November 18, 2009. The inspection report indicates the <br /> applicant is in compliance with the conditions of approval, and the excavation is proceeding in an orderly <br /> manner. The prcject.�vas referred to the Central Valley Flood Protection Board (CVFPB)for review. The <br /> CVFPB is responsible;for controlling flooding along the Sacramento and San Joaquin River. In a letter <br /> dated October 7, 2009, the CVFPB indicated their approval for the project. <br /> The project operates normally from April 15th to October 151h annually.
