� - c <br /> r <br /> Recommendations <br /> Action <br /> It is recommended that the Planning Commission: <br /> 1. Approve the Negative Declaration; and <br /> 2. .Approve the Rerislions of Approved Actions application for QX-89-0003 with a new expiration <br /> date of February 20, 2030; along with the previously approved ExcavationlReclamation Plan and <br /> previously approved Findings and Revised Conditions of Approval contained in the staff report. <br /> Previously Approved Findings <br /> t <br /> 1. The proposal is for the removal of scarce mineral resources and not for the removal of prime farmland <br /> because no topsoil will be removed, and only sand will be extracted from the site. Approximately 500,000 <br /> cubic yards of sand will be excavated over a five-year period. <br /> 2. The excavation will not have a detrimental effect on any surrounding agricultural land because dust <br /> control measureswill be utilized during excavation and processing operations, excessive noise will not be <br /> generated on the,'-site as a result of the project, and the days and hours of operation will be limited. <br /> 3. The proposed re}a. bilitation of the property, upon completion of the excavation, will leave the property in <br /> a condition which:will allow its reuse because the reclamation proposed will result in the sand bar portion <br /> of the site being gently sloped down to the San Joaquin River, which will prevent that portion of the site <br /> from being subject to continued erosion during flood stages of the river. <br /> 4. Issuance of the'R rmit shall not be significantly detrimental to the public health, safety, or welfare or be <br /> injurious to the property or improvements in the vicinity and district in which the property is located <br /> because dust coni rol measures will be implemented, no excavation activities will occur within the San <br /> Joaquin River, and a nine-acre wetlands area near the site will be created to off-set the loss of any <br /> vegetation from toe project site. <br /> Revised Conditions <br /> Unless otherwise specified, the approved use shall not be established nor building permits issued until the <br /> applicant has fulfilled all Conditions of Approval.` <br /> 1. PLANNING DIVISION <br /> a- The sandbar-skimming portion 'of the project shall be completed within five years of the <br /> commencement of operations. The on-going yearly maintenance skimming to,.maintain the river <br /> sand bar t6Lreg-la. "'*m^^ shall be permitted for 45 35 years thereafter. If the excavation does not <br /> commence within 18 months after the date of approval, the permit is terminated. The applicant shall <br /> notify the Planning Division in writing when the sandbar-skimming operations begin. The cLuarry <br /> expiration dot's is February 20, 2030. <br /> b. A performance guarantee is required to ensure site rehabilitation and compliance with Conditions of <br /> Approval. Tie amount of the guarantee is and will be fully in force for any phase which is being <br /> excavated. The estimated cost of rehabilitating each phase must be reviewed by the Department of <br /> Public Works and the McMullin Reclamation District No. 2075.
