The homesite shall not be transferred until October 6, 2021 or upon the death of an owner owning at least fifty (50) percent interest in the homesite parcel, unless the homesite parcel and Parcel 2 are merged pursuant to the provisions of the Development Title. The property shown on the Final Map is restricted from further subdivisions for homesite purposes, except for financing only, by Section 9-610.3 of the San Joaquin County Development Title. e. ACCESS: The following access requirements apply and shall be shown on the Final Map: (1) A proposed 25-foot wide private easement for access to parcels 3 and 4, along parcels 4 and 5, shall be shown on the Final Map. (Development Title Section 9-1150.15) (2) A proposed 25-foot wide private easement for access to the designated remainder, along parcel 8, shall be shown on the Final Map. The remainder parcel shall be designated and labeled as "Designated Remainder" on the Final Map. (Subdivision Map Act Section 66445) c. All easements of record shall be shown on the Final Map. (Development Title Section 9- 910.20) d. A minimum twenty-five foot (25) wide proposed private access and utility easement shall be provided for the benefit of Lots 1,2, 3 and 4. The requirement for this private access and utility easement shall a noticed by a statement on the Final Map and by a recorded Notice of Major Subdivision Restriction. The statement shall read as follows: We also hereby make an irrevocable offer to provide a 25-foot wide private access and utility easement across Lots 2, 3, 4, and 5 for the benefit of Lots 1, 2, 3, and 4, upon conveyance of Lots 1, 2, 3, 4 or 5 to another party. Said easement is not created by this map. Informational Notes: Any construction activity that results in the disturbance of at least one (1) acre of soil shall require a State NPDES construction permit. Dischargers whose projects disturb 1 or more acres of soil or whose projects disturb less than 1 acre of soil and is not part of a larger plan of development, are required to obtain coverage under the current General Permit for Discharges of Storm Water Associated with Construction Activity (www.swrcb.ca.gov/storrnwtr/gen const.html#const permit . Construction activity subject to this permit includes clearing, grading and disturbances to the ground such as stockpiling, or excavation, but does not include regular maintenance activities performed to restore the original line, grade, or capacity of the facility.
