Chapter 1 <br /> Introduction <br /> Proposed Project <br /> DeSilva Gates Construction,LLP,the project applicant(Applicant),has filed a <br /> quarry excavation permit with the San Joaquin County(County)Community <br /> Development Department for the proposed DeSilva Gates Quarry Project in <br /> southwestern San Joaquin County(proposed project or Project). The Applicant <br /> is proposing to mine an area located south of the city of Tracy and northeast of <br /> the intersection of Interstates 5 and 580 to extract aggregate and to operate a rock <br /> plant, asphalt and concrete batch plants,and a recycling plant. The Applicant has <br /> signed a long-term contract with Thoming Aggregates, LLP(site owner and <br /> Lessor), for use of the quarry site. <br /> r. The County's approval of the quarry excavation permit would allow the <br /> Applicant to conduct mining operations in the proposed project area and operate <br /> the plants as permitted under San Joaquin County Development Title 9, Chapter <br /> 9-954, Quarry Excavation Permits, and Chapter 9-1415, Quarry Excavation <br /> Standards. The site complies with the County's ordinance requirement for <br /> consideration of the permit because it is classified as MRZ-3 (Mineral Resource <br /> Zone 3: Areas of Undetermined Mineral Resource Significance) by the <br /> ` Department of Conservation and is identified in the San Joaquin County General <br /> Plan as containing significant sand and gravel aggregate resources. The site is <br /> zoned A/G(General Agriculture)and is designated as Prime Farmland. <br /> r <br /> Per Title 9, Chapter 9-854.5,to approve the project,the County must find that: <br /> r (a) The proposal is for the removal of regionally significant or scarce deposits <br /> of mineral resources and not for the removal of prime farmland; <br /> (b) The proposed reclamation of the property upon completion of the <br /> r excavation will leave the property in a condition which will allow its reuse; <br /> and <br /> (c) Issuance of the permit shall not be significantly detrimental to the public <br /> r health,safety,or welfare,or be injurious to the property or improvements in <br /> the vicinity (Ord.3675;3715) <br /> r <br /> DeSilva Gates Quarry Project <br /> Draft Environmental Impact Report 1-1 <br /> AS 05105.05 <br />
