Chapter 1
Introduction
Proposed Project
DeSilva Gates Construction,LLP,the project applicant(Applicant),has filed a
quarry excavation permit with the San Joaquin County(County)Community
Development Department for the proposed DeSilva Gates Quarry Project in
southwestern San Joaquin County(proposed project or Project). The Applicant
is proposing to mine an area located south of the city of Tracy and northeast of
the intersection of Interstates 5 and 580 to extract aggregate and to operate a rock
plant, asphalt and concrete batch plants,and a recycling plant. The Applicant has
signed a long-term contract with Thoming Aggregates, LLP(site owner and
Lessor), for use of the quarry site.
r. The County's approval of the quarry excavation permit would allow the
Applicant to conduct mining operations in the proposed project area and operate
the plants as permitted under San Joaquin County Development Title 9, Chapter
9-954, Quarry Excavation Permits, and Chapter 9-1415, Quarry Excavation
Standards. The site complies with the County's ordinance requirement for
consideration of the permit because it is classified as MRZ-3 (Mineral Resource
Zone 3: Areas of Undetermined Mineral Resource Significance) by the
` Department of Conservation and is identified in the San Joaquin County General
Plan as containing significant sand and gravel aggregate resources. The site is
zoned A/G(General Agriculture)and is designated as Prime Farmland.
r
Per Title 9, Chapter 9-854.5,to approve the project,the County must find that:
r (a) The proposal is for the removal of regionally significant or scarce deposits
of mineral resources and not for the removal of prime farmland;
(b) The proposed reclamation of the property upon completion of the
r excavation will leave the property in a condition which will allow its reuse;
and
(c) Issuance of the permit shall not be significantly detrimental to the public
r health,safety,or welfare,or be injurious to the property or improvements in
the vicinity (Ord.3675;3715)
r
DeSilva Gates Quarry Project
Draft Environmental Impact Report 1-1
AS 05105.05
