Development Title Section 9-1415.3(k)(5) <br /> states that temporary cut slopes shall not exceed one (1)foot horizontal to one (1)foot <br /> vertical, except that temporary cut slopes at setback lines to a maximum of one half(1/2) <br /> of a foot horizontal to one (1) foot vertical may be maintained if site-specific geologic and <br /> engineering analysis demonstrate through a slope stability analysis that the proposed <br /> temporary cut slopes will have a minimum slope stability factor of safety as required in <br /> Section 9-1415.3(k)(4). The applicant has submitted a Geotechnical Services Report: <br /> Slope Stability Analysis for the proposed quarry (dated August 21, 2003). The <br /> Community Development Department and Department of Public Works will review this <br /> report for compliance with the Development Title standards in regards to slope stability. <br /> The quarry walls will later be reclaimed using overburden soils at a slope of 1 %: 1 (1 'h <br /> horizontal to 1 vertical). The final topographic configuration will be a basin with 1 % : 1 <br /> side slopes, Development Title Section 9-1415.3(k)(6)(A) states that the maximum final <br /> cut and/or fill slopes shall not exceed two (2) feet horizontal to one.(1) foot vertical. <br /> However, finals slopes to a maximum 1 '/_: 1 may be maintained when site specific <br /> geological and engineering analysis demonstrate through a slope stability analysis that <br /> the proposed final slopes will have a minimum slope stability factor of safety as required <br /> in Section 9-1415.2(k) (4), while demonstrating suitability for the proposed end use and <br /> protecting against erosion (by means'of vegetation or other methods approved by <br /> Development Services Division). The applicant has submitted a Geotechnical Services <br /> Report: Slope Stability Analysis for the proposed quarry (dated August 21, 2003). The <br /> Community Development Department and Department of Public Works will review this <br /> report for compliance with the Development Title standards in regards to slope stability. <br /> According to the Excavation Plan (site plan 2 of 7), no excavation will occur within <br /> approximately 40-50 feet from the base of the Delta Mendota Canal. There is not <br /> substantial evidence to indicate that this project might have a significant impact on the <br /> Delta Mendota Canal <br /> 2.c. Agriculture: <br /> The Department of Conservation classifies the project site as Prime Farmland. The site <br /> is currently planted in almond orchards. The applicant is proposing to reclaim the <br /> majority of the project site back to agriculture. However, the applicant has proposed that <br /> the northern portion of the project site potentially be reclaimed to a water storage pond <br /> for agricultural use. Although proposed for agricultural irrigation purposes, a potential <br /> water storage pond would be considered a significant loss of agricultural land. The <br /> applicant states that the second option would be to reclaim the same area back to <br /> agriculture. If the area is backfilled with overburden and topsoil, the impact to <br /> agricultural land would be less than significant. This issue requires further review. <br /> 3.a.&b. Plant/Animal Life: <br /> The San Joaquin Council of Governments has indicated in a telephone conversation on <br /> March 19, 2004, that the project will result in the conversion of Multi-Species Open <br /> Space to Non Open Space and recommends participation in the San Joaquin Multi- <br /> Species Habitat Conservation Plan (SJMSHCP). Participation in the SJMSHCP will <br /> reduce potential loss of habitat impacts to less than significant. If the applicant decides <br /> to participate in the SJMSHCP, the mitigation fees ($862.00/acre) will be collected at the <br />
