Analysis <br /> Background <br /> This project application was submitted in December 2001. A similar application for a Surface Mining Use <br /> Permit was submitted to the Stanislaus County Department of Planning and Community Development in <br /> June 2002 for the portion of the project located in Stanislaus County. In October of 2003 a revised <br /> application and reclamation plan was submitted. The Draft Environmental Impact Report was completed in <br /> May of 2006 and the Final Environmental Impact Report was completed in June 2008. <br /> The proposed CEMEX Vernalis Quarry is to replace the Huck Quarry located on the east side of Tracy <br /> Boulevard, one mile south of Linne Road, south of Tracy. That facility is expected to be closed within the <br /> next ten years. <br /> Environmental Review <br /> A Draft EIR was prepared for this project. A 45-day public review period was provided in accordance with <br /> CEQA. All comments have been responded to and a Final EIR has been prepared for consideration by the <br /> Planning Commission. The Final EIR includes the Draft EIR by reference. The Final EIR, including the <br /> response to comments and the Draft EIR, is provided under separate copy. <br /> The EIR determined that he project would result in significant and unavoidable impacts relative to noise and <br /> air quality. The project would also contribute to cumulative significant and unavoidable impacts relative to <br /> noise and air quality. Finally, the EIR determined that there were no growth inducing impacts. <br /> The EIR reviewed the environmental issues associated with two mining options. In the first option (the <br /> project) no excavation is allowed in or near Hospital Creek. In the second option, mining occurs in the <br /> current creek area. The EIR determined that the second option would result in significant unavoidable <br /> hydrologic impacts, so the applicant chose to proceed with the first option. This staff report is for the first <br /> option that avoids the creek. <br /> The Draft EIR originally addressed reviewed three traffic route options. For various reasons, option two was <br /> eliminated and will not be further discussed in this report. Option one requires the construction of the <br /> Interstate 5/Blewett Road interchange. Option three would provide access to the site without the <br /> interchange (see Figures Revised 4.4-3a and Revised 4.4-3b). <br /> A brief discussion of the environmental issues is provided below. <br /> Air Quality <br /> The project would have potentially significant impacts relative to project construction, project operation- <br /> phased emissions, project diesel particulate matter(DPM). After mitigation, project construction and DPM <br /> impacts would be less than significant. However, air quality impacts related to project operation-phased <br /> emissions would remain significant even after implementation of Best Available Control Technologies <br /> (BACT). Reactive Organic Gas(ROG) emissions would be just above significance levels in 2008 for annual <br /> production levels of 4 million tons. Nitrogen Oxides(NOx)emission would be 4 to 14 times above the <br /> significance criterion under various scenarios analyzed in the EIR.
