1. INTRODUCTION <br /> type of EIR focuses primarily on the changes in the environment that would occur as a result of <br /> project development,and examines all phases of a particular project(i.e.,planning,construction, <br /> operation). Ultimately,the EIR is used by the Lead Agency as a tool in evaluating a Proposed <br /> Project's environmental impacts and can be further used to modify,approve,or deny approval of <br /> a Propose Project based on the analyses provided in the EIR. <br /> 13 CEQA EIR PROCESS <br /> 1.3.1 LEAD AGENCY <br /> The County of San Joaquin(County)is the Lead Agency for preparation of the RMC Pacific <br /> Vernalis Quarry Mining and Reclamation Project EIR. Sections 15050 and 15367 of the State _ <br /> CEQA Guidelines define the"lead agency"as the "public agency which has the principal <br /> responsibility for carry out or approving a project." Approximately 590 acres or 85 percent of the <br /> proposed quant'site is located in San Joaquin County and the remaining portion of the quarry _ <br /> site, approximately 98 acres,is located in Stanislaus County. For processing the applications and <br /> completing the EIR,the Community Development Departments for the respective counties have <br /> agreed that San Joaquin County will be the lead agency and Stanislaus County will be the <br /> responsible agency. A Lead Agency Determination Agreement between San Joaquin County and <br /> Stanislaus County was passed and adopted by the San Joaquin County Board of Supervisors on <br /> October 8, 2002. The Notice of Preparation was circulated to the public,local, <br /> state, and federal agencies and other interested parties to inform responsible agencies and the <br /> public that the Proposed Project could have significant effects on the environment and to solicit <br /> their comments. Concerns raised in response to the Notice of Preparation were considered during — <br /> preparation of the Draft EIR. The Notice of Preparation and attached Initial Study that scoped <br /> out the issues that were determined by San Joaquin County not to be significant was prepared and <br /> is presented in Appendix A.
