• Specific economic, legal, social, technological, or other considerations, including considerations for the provision of employment opportunities for highly trained workers, make infeasible the mitigation measures or project alternatives identified in the final EIR, but specific overriding economic, legal, social, technological, or other benefits of the project outweigh the significant effects on the environment. (Public Resources Code § 21081; CEQA Guidelines § 15091(a).) This County hereby finds that the followingpotential environmental impacts can and will be mitigated to below a level of significance, with implementation of the mitigation measures recommended in the EIR. D.2.1. Land Use Impact 4.2.1 The Proposed Project has the potential to conflict with existing and planned land uses surrounding the project site. (Draft EIR,p. 4.2-8.) Significance Before Mitigation: Potentially Significant. Facts: Operation of the project has the potential to result in incompatibilities related to air quality, noise,traffic and visual resources, which could impact adjacent land use absent mitigation. See Draft EIR, p. 4.2-8. Mitigation Measures: Mitigation Measure 4.2.1: Implement Mitigation Measures 4.4.1a and b; 4.4.2; 4.4.3; 4.4.4 (traffic mitigation); 4.5.1a,b, c and d; 4.5.2; 4.5.3 (noise mitigation); 4.6.1; 4.6.2; 4.6.4 (air quality mitigation); and 4.12.2 (visual resources mitigation). (Draft EIR,p. 4.2-8.) Findings: Based on the whole record, this Commission finds that with implementation of Mitigation Measure 4.2.1, impacts related to potential conflict with surrounding land uses are reduced to a less than significant level. (Draft EIR, p. 4.2-8.) Impact 4.2.3 The Proposed Project could conf ict with an applicable habitat conservation plan or natural community conservation plan. (Draft EIR, p. 4.2-11.) Significance Before Mitigation: Potentially Significant. Facts: The project has the potential to impact species covered by the San Joaquin County Multi- Species Habitat Conservation Plan (SJMSCP). See Draft EIR,p. 4.2-11. Mitigation Measure 4.2.3: Implement Mitigation Measures 4.9.2a—c (addressing impacts to covered species). As discussed in Section 4.9 of the Draft EIR, the applicant has the option to implement either the SJMSCP or equivalent mitigation measures. Either of these options would 10
