c. A video tape of the planned haul routes showing conditions of all San Joaquin County roads shall be submitted to Public Works. The condition of County maintained roads along the haul route shall be reviewed by Public Works prior to the start of excavation. (Development Title Section 9-1415.2) d. Loads on all public roads shall be limited to legal loads only. (Vehicle Code Section 35551) e. An encroachment permit shall be required for work within public road rights-of-way. (Development Title Sections 9-1145.4 and 9-1145.5) f. The applicant shall pay a fair share of the funding for the improvements to the State Route 132/Bird Road interchange project and improvements connected with the interchange construction. Fair share means the fair share of 100 percent of the project cost shared solely between the Vernalis area aggregate operators and excluding existing traffic. g. Financing for the future State Route 132/Bird Road interchange shall be completed prior to any material leaving the properties under this permit. Financing shall be considered complete after a Mello-Roos District is formed and the sale of all bonds necessary to complete the construction of the interchange is conducted. Work that is preliminary to mining such as landscaping, stripping overburden, construction of berms, other site preparation, and installation of a conveyor system will be permitted to proceed prior to the interchange financing being complete. h. Once the financing for the State Route 132/Bird Road interchange is completed, the mined product traffic shall be restricted to the Alternate 3 haul route(revised as follows: Koster Road to Blewett Road to Welty Road to State Route 33 to Interstate 5). Any future reference to Alternate 3 haul route shall mean the revised version per above. Tonnage for this permit shall be restricted to 1.08 million tons per year on this alternate route. i. Once the future SR 132/Bird Road interchange is complete and open to traffic, the mined product traffic shall be restricted to Alternate 1 haul route(Koster Road to Blewett Road to Bird Road to State Route 132). Tonnage for this permit will not be restricted on this route. j. The haul routes shall be approved by Public Works from the project site. The portion of Koster Road north of Blewett Road shall not be considered as the haul route for the project. An engineering study of County roadways used as haul routes shall be required. The engineering study shall determine the adequacy of roadway width requirements, structural section, R-value, traffic index, overall safety, and shoulder requirements. The study shall be based on cumulative traffic generation of existing and future mining operations in the Vernalis area. The report shall also recommend improvements required to County roads to mitigate the increased truck traffic to comply with the County level of service standards on roadways and intersections. The applicant shall also be required to do all mitigations required by the engineering study and all mitigations as required by Public Works, Stanislaus County, and Caltrans. The report shall specifically study enhancements needed to accommodate truck turning movements using truck turn templates at the intersection of Koster Road and Blewett Road for Alternate 1 and Alternate 3 routes. The report shall also specifically study enhancements needed to address safety concerns for the Alternate 3 route, including the intersection of Welty Road and SR 33 related to sight lines, turning radii, and queuing at the railroad track. To the extent feasible as determined by San Joaquin County, Stanislaus County, and Caltrans, this intersection shall make the following improvements: (1) Construct 4-foot shoulders beyond the outermost truck wheel tracks. (2) Reconfigure intersection striping to prevent turning trucks from crossing over double yellow stripes.. Conditions of Approval - 13 - QX-01-0002
