4.2 Land Use <br /> Surface Mining and Reclamation Act <br /> The project is consistent with SMARA, and with the San Joaquin County and the Stanislaus <br /> County standards for SMARA implementation. As stated above, the project conditions included <br /> ` in the project description,as well as implementation of the mitigation measures included in this <br /> EIR, will ensure that the project fulfills the requirements of SMARA. <br /> ` As a result of the project's consistency with the San Joaquin County and Stanislaus County <br /> General Plans,Zoning Codes,and SMARA, a less-than-significant impact will result. <br /> Mitigation: No mitigation is required. <br /> Impact 4.2.3: The project could conflict with an applicable habitat conservation plan or <br /> natural community conservation plan.This would be a potentially significant impact. <br /> The project has the potential to impact species covered by the San Joaquin County Multi-Species <br /> Habitat Conservation Plan(SJMSCP). Implementation of the project, therefore, could conflict <br /> with implementation of the SJMSCP, resulting in a potentially significant impact. <br /> Mitigation Measures <br /> r <br /> Measure 4.2.3: Implement Mitigation Measures 4.9.2a-c. Mitigation Measures 4.9.2a-c <br /> address impacts to covered species. The applicant has the option to implement either the <br /> t" SJMSCP or implement equivalent mitigation measures described in Section 4.9, Biological <br /> Resources. Implementation of either of these options would result in a less-than-significant <br /> planning impact.
