4.Environmental Analysis
but not limited to Sections 9-600 through 9-610, 9-854, and 9-1400 through 9-1415 of the —
Development Title will ensure that the project is consistent with the County Zoning Code and
with SMARA. In addition, the project conditions included in the project description as well as
implementation of the mitigation measures included in this EIR will ensure that that the Proposed —
Project fulfills the requirements set forth in the Agricultural Land Use and Quarry Mining
sections of the Zoning Code.
Stanislaus County General Plan
The development of mining operations and aggregate processing facilities at the project site is —
generally consistent with the current Stanislaus County General Plan designation of Agriculture.
Although intended primarily for agricultural use, this designation allows for uses that are not
compatible with urban uses—including the management and procurement of mineral resources—
provided that they do not conflict with agriculture.
Consistent with General Plan Land Use Policies 2 and 14, use of the project area will be limited
to activities compatible with agriculture, including natural resource management. Consistent with
the General Plan Land Use Policy 17,development of the proposed quarry will promote the
diversification of the local economy. Finally, consistent with Land Use Policy 18, the
implementation of the Proposed Project will accommodate the siting of an industry with unique
requirements, i.e. one whose location is determined by geology. For a discussion of General Plan
consistency for other environmental resource areas, the reader is directed to the individual
sections of this Draft EIR.
Stanislaus County Zoning Ordinance
As a condition of project approval, the Proposed Project will be required to comply with the
agricultural land use and quarry and mining land use regulations specified in the Stanislaus
County Zoning Code. Chapter 21.20.030 of the Zoning Code identifies earth and/or mineral
extraction as "Tier Three" land use, which, although not directly related to agriculture, may be
allowed providing the use is not seriously detrimental to surrounding agriculture, and that the
land may be reasonably returned to agricultural use in the future. Under the Zoning Ordinance,
the Proposed Project will need to obtain a use permit and approval by the Planning Commission. —
In addition,Chapter 21.88 of the Zoning Ordinance incorporates the regulations defined under
SMARA,and requires the Proposed Project to meet applicable standards, including, but not _
limited to those regarding reclamation, findings for approval, financialassurances, inspections,
and mineral resource protection.
Compliance with the above regulations will ensure that the Proposed Project is consistent with
the County Zoning Code. In addition, the project conditions included in the project description as
well as implementation of the mitigation measures included in this EIR will ensure that the _
project fulfills the requirements set forth in the County Code.
RMC Pacific Vernalis Quarry Mining and Reclamation Project 4.2-10 ESA/203015
Draft Environmental Impact Report May 2006
