6.Other Statutory Considerations <br /> plant location,and one west of the mining area across the Delta-Mendota Canal. Portions of the <br /> processing plant will reach approximately 100 feet above ground level and will be visible from <br /> the nearby homes and to travelers along local roads(Blewitt, Koster, Koster Road, Chrisman and <br /> Gaffery Roads and State Routes 132 and 33) and designated State and County Scenic Highway I- <br /> 5. As a condition of approval for the project, a landscaping plan has been submitted to San <br /> Joaquin County for approval. This plan must be consistent with County landscaping regulations <br /> as laid forth in Chapter 9-1020 of the San Joaquin County Development Title, including those — <br /> standards for vegetation composition and water efficiency,earthen berms, erosion control and <br /> landscaping maintenance. <br /> The project design minimizes the degree of visual impacts from the mining operation with the <br /> inclusion of vegetated berms along Blewitt Road and a portion of Koster Road. The landscape <br /> berm will include a double row of trees and non-irrigated hydroseed mix that will serve to screen — <br /> in part the plant facilities. All other setbacks are proposed to be 25 feet.Finally, upon completion <br /> of mining activities,the project site will be reclaimed to agricultural land. The proposed — <br /> landscape berms would help to reduce the visual impact of the new mining operation. In addition, <br /> much of the quarry work will be performed up to 120 feet below grade in the excavation pits and <br /> will not be visible from the surface. Because of this, the project's contribution is not considerable <br /> and the cumulative impact is less than significant. <br /> Mitigation Measure: No mitigation is required. — <br /> Hazards and Hazardous Materials <br /> There are no significant cumulative hazards and hazardous materials impacts. — <br /> 6.3 Significant Unavoidable Adverse Impacts <br /> 6.3.1 Introduction <br /> The CEQA Section 21100(b)(2)and CEQA Guidelines Section 15126.2(b) require that any <br /> significant and unavoidable effect on the environment must be identified. In addition, Section <br /> 15093(a)of the CEQA Guidelines allows the decision-making agency to determine if the benefits <br /> of a proposed project outweigh the unavoidable adverse environmental impacts of implementing <br /> the project. The County can approve a project with unavoidable adverse impacts if it prepares and <br /> adopts a"Statement of Overriding Considerations" setting forth the specific reasons for making <br /> such a judgment.
