6 <br /> • Page 2 March 9,2000 <br /> The applicant is aware that delaying reclamation may. require the applicant to <br /> m <br /> continue bonding of the excavation phase until reclamation is complete. <br /> fete. <br /> B.} Condition 1-u requires the applicant to store water, in the initial settling pond, <br /> below the invert of the Delta Mendota Canal. The applicant would like to store <br /> water, in this pond, at an elevation higher that the invert of the Delta Mendota <br /> Canal. This option was addressed in the E.I.R. 96-03, as Mitigation Measure <br /> 4.2-7a, however was not listed as an option on the Conditions of Approval. At <br /> this time, the applicant would also like to revise the location of the initial settling <br />{ pond from the northwest corner to the northeast corner of the property, and add a <br /> dike around the top of the pond. The pond was relocated due to a change in <br /> location of-the access road that leads to Blewett Road (noted as alternate #3 in <br /> E.I.R. 96-03). The addition of the dike around the top of the pond will partially <br /> i increase the holding capacity of the pond and act as a safety barrier between the <br /> pond and surrounding areas. The dike will be engineered and constructed to meet <br /> governing regulations for such a project. Any water stored behind the dike will <br /> be less than 50 acre-ft. and therefore will not require a Dam Safety Permit. The <br /> applicant understands that an engineering analysis, with recommendations for <br /> mitigation to offset any potential impacts, must be submitted to the development <br /> department for approval. (Please see attached engineering analysis and <br /> recommendations.) <br /> Public Works—(staff contact: Gabe Karam @ 468-3023) <br /> A.) Condition 2-a-1 is being revised per the request of the Public Works Department <br /> t in order to clarify that Koster Road will not be used as a haul route for this project. <br /> j (See attached revised conditions for illustration of change to the condition). <br /> B.)
