Analysis <br /> Background. <br /> Ordinarily a single family residence and a temporary corporation yard require only ministerial review. In this <br /> case, a Site Approval(discretionary review) is required for both items because they are located in an area of <br /> significant sand and gravel deposits (Development Title Section 9-1525) and designated Resource <br /> Conservation on the 2010 General Plan map (Development Title Section 9-605.6[j] and Open Space <br /> Implementation Measure 2.1b], GP Vol. I, P. VI-7). These items have been referred to the Planning <br /> Commission because the Planning Commission and Board of Supervisors previously denied residences at <br /> this and adjacent sites. <br /> PA-0200306 Site Approval for four residences <br /> • On September 12, 2002, the Community Development Department approved Site Approval <br /> Application PA-0200306 of Roger Towers to construct four single family residences on the two <br /> project parcels and one adjacent parcel. <br /> • On September 23, 2002, in two separate appeals, Jose L. Alva and RMC Pacific Materials, Inc., <br /> appealed the Community Development Department's approval to the Planning Commission. <br /> • On January 9, 2003, the Planning Commission upheld both appeals, thus denying Site Approval <br /> application PA-0200306. The Planning Commission was unable to make finding No. 5 regarding <br /> compatibility with adjoining land uses and expressed concerns regarding water pollution, trucks on <br /> Koster Road, noise, dust, and vibrations. <br /> • On March 25, 2003, the Board of Supervisors denied an appeal by Roger Towers of the Planning <br /> Commission's action, thus denying the Site Approval application for the four residences. <br /> No application may be accepted if a similar application has been finally denied during the immediately <br /> preceding one year period (Development Title Section 9-220.14). Because it has been more than one year <br /> since the Board's action, the applicant may apply again for a residence. <br /> PA-0600664 Text Amendment to add a use e: Quar /Construction Operations Support) <br /> • On March 271'.1 2007 the Planning Commission denied Development Title Text Amendment <br /> application PA-0600664. The Text Amendment application would have created a new use type <br /> "Quarry/Construction Operations Support"to be conditionally permitted in the AG zones. <br /> • On July 22, 2008, the Board of Supervisors denied an appeal by Roger Towers of the Planning <br /> Commission's action, thus denying the Text Amendment Application. <br /> In the Board Letter prepared for the appeal, the Community Development Department stated: <br /> The Community Development Department has determined that Mr. Towers may apply for a Site <br /> Approval application for the uses proposed in his Text Amendment application. Those uses <br /> include truck parking, equipment storage, maintenance/repair facilities, and administrative office <br /> space associated with those uses. Site Approval applications are subject to environmental <br /> review under CEQA.
