CONDITIONS OF APPROVAL <br /> SA-00-38 <br /> Souza <br /> Site Approval Application No. SA-00-38 was approved by the San Joaquin County Community <br /> Development Department on August 28, 2000. The effective date of approval is September 7, 2000. <br /> This approval will expire on March 9, 2001, which is six months from the effective date of approval, <br /> unless (1) all Conditions of Approval have been complied with, (2) all necessary building permits <br /> have been secured and remain in force, and (3) all necessary permits from other agencies have <br /> been secured and remain in force. <br /> Unless otherwise specified,all Conditions of Approval and Ordinance requirements shall be fulfilled <br /> prior to the establishment of the use and the issuance of any building permits. Those Conditions <br /> followed by a Section Number have been identified as Ordinance requirements pertinent to this <br /> application. Ordinance requirements cannot be modified, and other Ordinance requirements may <br /> apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT (Staff Contact:Tina Wehrmeister,468-8477) <br /> a. APPROVED USE: This approval is for a 130-rooster/poultry ranch as shown on the Plan submitted <br /> July 17, 2000. <br /> b. ANIMAL REGULATIONS: The following animal regulations apply and shall be provided: <br /> (1) All animal enclosures, including but not limited to pens, cages, and feed areas, shall be <br /> maintained free from litter,garbage,and excessive accumulation of manure,so as to discourage <br /> the proliferation of flies, other disease vectors, and offensive odors. The premises shall be <br /> maintained in a neat and sanitary manner.(Development Title Section 9-1045.7[b]) <br /> (2) Except for movement on and off the property, animals shall not be kept or maintained in coops, <br /> pens, corrals, or within barns or similar structures closer than 100 feet from any rear or side <br /> property line. (Development Title Section 9-1045.3) <br /> (3) Use of the approved facility shall not violate Section 597 or any subsection thereof of the <br /> California Penal Code. <br /> c. COMPLIANCE DATE: Because this development is currently operating without the required <br /> permits, the Site Plans shall be submitted within 60 days from the date of this approval letter. <br /> Enforcement action will be deferred if the Site Plan is submitted within 60 days, and the Conditions of <br /> Approval are met within six months from the date of this approval letter. <br /> 2.
