Mitigated Negative Declaration for the Lathrop Irrigation District <br /> Formation. Adopted November 10,2001 <br /> 2.9 Land Use and Planning <br /> LID is an irrigation district formed under State law to provide certain utility services, but has no land use <br /> authority. The land uses currently on the Project site are agricultural in nature, but have been approved <br /> for extensive urbanization. This urbanization will give rise to a significant number of customers of <br /> electrical and telecommunication services from LID. <br /> The proposed project site will encompass over 5,600 acres on Stewart Tract and Paradise Cut, in the West <br /> Lathrop portion of the City of Lathrop, in San Joaquin County. Stewart Tract is an inland island in the <br /> Sacramento-San Joaquin River Delta, and Paradise Cut is a flood control bypass connecting the San <br /> Joaquin River and Old River.The entire area is located within the Secondary Zone of the Delta as <br /> designated by the State's Water code. <br /> The proposed service area of LID corresponds to the entire River Islands planning area of West Lathrop. <br /> This planning area is composed of two primary areas: the Paradise Cut Conservation Area(PCC)and the <br /> River Islands Development Area(RID Area),which is the portion of the project site to be developed, is <br /> bordered generally on the west by Old River,on the north by Old River and the San Joaquin River,on the <br /> east by UPRR tracks(formerly owned by SPRR),and on the south by Paradise Cut. <br /> The PCC Area is located south of the RID Area, in the area contained within the Paradise Cut levees, <br /> between Old River and the UPRR tracks. Another part of the River Islands program,but not included for <br /> urbanization and not within the current City limits is the Paradise Cut Improvement Project Area(PCIP) <br /> that is located in Paradise Cut, southeast of Interstate 5 (1-5); this area is not part of the LID Project area. <br /> The remainder of Stewart Tract located southeast of the UPRR tracks and north of Paradise Cut, is not <br /> part of either the River Islands Project,or the LID service area. In the River Islands EIR this area is <br /> referred to as Remaining Stewart Tract. <br /> The RID portion of the River Islands project,as mentioned elsewhere in this document, proposes 11,000 <br /> new residential dwelling units and 4,500,000 square feet of commercial and office uses,as well as lakes, <br /> open space,golf courses and other water related recreational opportunities. Impacts relating to this mixed <br /> use planned development were fully identified,analyzed and mitigated for in the River Islands EIR. <br /> 2.9.1. Regulatory Background <br /> City of Lathrop General Plan <br /> A city's or county's general plan functions as a"constitution" regarding all future physical development in <br /> an area. All other city or county implementing plans and ordinances that relate to the area governed by the <br /> general plan must be consistent with it.The general plan is a comprehensive, long-term,and general <br /> document that describes proposals for the physical development of the city or county and of any land <br /> outside its boundaries that in the city's or county's judgment bears relation to its planning(California <br /> Government Code Section 65300 et seq.). It is comprehensive in that it addresses a broad range of aspects <br /> if the community's existing and future physical development, including,at a minimum, land use, <br /> 46 <br />
