CONDITIONS OF APPROVAL <br /> MS-95-32 <br /> Haywood, et al <br /> On July 14, 1995,the San Joaquin County Community Development Department approved MS-95-32 <br /> subject to the Conditions of Approval listed below. This approval will expire 36 months from the date <br /> of approval unless (1) all Conditions of Approval have been compiled with and (2) a Parcel Map has <br /> been submitted to the County Surveyor for approval. <br /> Those Conditions followed by a Section Number have been identified as ordinance requirements <br /> pertinent to this application. Ordinance requirements cannot be modified, and other ordinance <br /> requirements may apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT: (Staff Contact: Chandler Martin, 468-3190) <br /> a. LOT SIZE AND WIDTH: The following lot size and width regulations shall apply to this <br /> map: <br /> (1) All parcels shall have a minimum lot width of 150 feet, measured at the front yard <br /> setback line. (Development Title Section 9-310.4) <br /> (2) All parcels shall have a minimum lot area of two acres net. (Development Title <br /> Section 9-310.3) <br /> b. TREE PRESERVATION: Future development on the parcels shall be consistent with the <br /> requirements of the County's Tree Preservation Ordinance. (Development Title Section <br /> 9-1505) <br /> C. RIPARIAN HABITAT ZONE: Parallel to the swale, a natural open space for riparian <br /> habitat and waterway protection shall be maintained to provide nesting and foraging <br /> habitat and the protection of waterway quality. The minimum width of said open space <br /> shall be 100 feet, measured from the mean high water level of the natural bank, or 50 feet <br /> back from the existing riparian habitat, whichever is greater. Water-dependent uses may <br /> be permitted in this buffer. The mean high water level and the edge of the riparian <br /> habitat shall be shown on the Parcel Map. The open space buffer required above shall <br /> be shown on the parcel map with the following note: <br /> • Pursuant to Section 9-1510.5 of the San Joaquin County Development Title, this <br /> area is designated as a natural open space for riparian habitat and waterway <br /> protection. No development other than water dependent uses shall be permitted <br /> in this space. <br /> d. CULTURAL RESOURCES: If, in the course of development, concentrations of prehistoric <br /> or historic-period materials are encountered, all work in the vicinity of the find shall halt <br /> until an archaeologist can evaluate the materials and make recommendations for further <br /> action. If human remains are encountered, all work shall haft in the vicinity, and the <br /> County Coroner shall be notified immediately. At the same time, a qualified archaeologist <br /> shall be contacted to evaluate the finds. If human burials are found to be of Native <br /> American origin, steps shall be taken pursuant to Appendix K of the California <br /> Conditions of Approval - 1 - MS-95-32 <br />
