t <br /> CONDITIONS OF APPROVAL <br /> PA-1500070 <br /> Lincoln Properties, LTD. <br /> Variance application no. PA-1500070 was approved by the San Joaquin County Planning <br /> Commission on August 20, 2015. The effective date of approval is August 31, 2015. This approval <br /> will expire on February 28, 2017, which is 18 months -from the effective date of approval, unless (1) <br /> all Conditions of Approval have been complied with (2) all necessary building permits have been <br /> issued and remain in force, and (3) all necessary permits from other agencies have been issued <br /> and remain in force. <br /> Unless otherwise specified, all Conditions of Approval and ordinance requirements shall be fulfilled <br /> prior to establishment of the use and the issuance of any building permits. Those Conditions <br /> followed by a Section Number have been identified as ordinance requirements pertinent to this <br /> application. Ordinance requirements cannot be modified and other ordinance requirements may <br /> apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT (Contact Staff: Megan Aguirre, [209]468-3144) <br /> a. BUILDING PERMIT: Submit an "APPLICATION-COMMERCIAL BUILDING PERMIT". The Site Plan <br /> required as a part of the building permit must be prepared by a registered civil engineer or licensed <br /> architect. This Plan must show drainage, driveway access details including gates, on-site parking, <br /> landscaping, signs, existing and proposed utility services, and grading (refer to the "SITE PLAN <br /> CHECK LIST'for details). Foundation and soils investigation shall be conducted in conformance with <br /> Chapter 18 of the California Building Code at the time of permit application. A fee is required for the <br /> Site Plan review. (Development-Title Section 9-884) <br /> b. APPROVED USE: This approval is for a Variance application to vary the requirements of the <br /> Development Title to permit additional signs and to reduce the required setback for signs and walls <br /> within an existing shopping center in the Community Commercial (C-C) zone in two phases over 5 <br /> years as shown on the revised Site Plan dated July 30, 2015. <br /> Phase 1 includes: <br /> • Construction of two (2)additional signs and two(2) replacement signs. <br /> • Increasing the maximum permitted height of three (3)walls from 3 feet to 6 feet. <br /> • Increasing the maximum permitted height of one(1)wall from 3 feet to 9 feet, 4 inches. <br /> • Reducing the required setback from 5 feet from future right-of-way lines to 0 feet for one (1) <br /> monument sign. <br /> Phase 2 includes: <br /> • Construction of two (2) additional poles for a single archway sign extending across the right-of- <br /> way for Benjamin Holt Drive. <br /> • Reducing the required setback from 5 feet from future right-of-way lines to 0 feet for the archway <br /> sign poles. <br /> c. CAPITAL FACILITY FEE: This project may be subject to the Capital Facility Fee. If the Capital <br /> Facility Fee is applicable, the County shall collect the fees before the issuance of any building <br /> permits. (Development Title Section 9-1245.2) <br /> d. SETBACKS: All other development shall comply with setback requirements as specified in <br /> Development Title Table 9-410.3. <br /> PA-1500070 (VR) Conditions of Approval 1 <br />
