l � <br /> Analysis <br /> Background <br /> On March 12, 2002, the Board of Supervisors approved General Plan Amendment No. GP-01-0014 and <br /> Zone Reclassification No. ZR-01-0010 to amend the General Plan designation and Zoning of 11.32-acres <br /> from Rural Residential (R/R and R-R) to Residential-Very Low Density (R/VL and R-VL). <br /> Services <br /> The proposed subdivision will be served by County Service Area (CSA)44 for water, sanitary sewer, and <br /> storm water drainage. <br /> Acoustical Studv <br /> Development Title Table 9-1025.9 lists residential uses as noise sensitive receptors(Development Title Table <br /> 9-1025.9). Outdoor activity areas shall have a noise level of less than 65 dB Ldn, and interior spaces shall <br /> have a noise level of less than 45 dB Ldn. The 65 dB noise contour is 121 feet from the edge of Linne Road <br /> and 213 feet from the edge of the Union Pacific Railroad. The Community Development Department <br /> considers the lot along Linne Road to be an infill lot because there are a number of parcels already existing <br /> along Linne Road. There are subdivisions on either side of the proposed subdivision that have masonry <br /> sound-walls along the Union Pacific Railroad. The Community Development Department is recommending <br /> as a Condition of Approval that a masonry wall of the same height be constructed along the 147-foot northern <br /> property line of the subdivision adjacent to the railroad to provide noise attenuation. <br /> Neighborhood Opposition <br /> The Community Development Department received a letter from Castello Estates I, LLC, and Linne <br /> Estates, LLC, stating that Castello Estates is the owner and operator of the community water system and <br /> Linne Estates, LLC, is the owner and operator of the wastewater system that the applicants are intending <br /> to use to serve the proposed subdivision. The letter also indicates that a"Will Serve" letter for services <br /> will be furnished when the applicant provides a payment for services to the operators. The Community <br /> Development Department has provided a copy of the letter to the Public Works Department. <br /> The Department of Public Works responds to the letter by stating that the water system in Castello <br /> Estates is currently in the process of being accepted by San Joaquin County. The wastewater treatment <br /> plant and system in Linne Estates(now referred to as Carbona Station) is currently under construction. <br /> These improvements will be part of CSA 44 when accepted by San Joaquin County. An Infrastructure <br /> Reimbursement Agreement is currently being prepared for approval by the Board of Supervisors to <br /> reimburse Castello Estates I, LLC, and Linne Estates for the costs of water system and sewer system <br /> improvements installed above the needs of their development. If the Reimbursement Agreement is <br /> approved by the Board of Supervisors, the reimbursement costs will be paid by the developer of the <br /> properties, on a pro-rated basis, that benefit from the prior installed improvements. <br /> San Joaquin County PA-0400276Wurora Transportation <br /> Community Development Page 3 <br />
