Analysis <br /> Background <br /> On June 13, 1979, the San Joaquin County Planning Department approved PM-79-0192 to subdivide a 59- <br /> acre parcel into two 29.5-acre lots. The purpose of the subdivision was to settle an estate between two <br /> family members. Because the proposed subdivision was considered "inconsistent with the agricultural <br /> designation of the property", a note was placed on the Parcel Map (recorded on Book 8, Page 82) stating <br /> that Parcel B would not be a residential building site. <br /> On June 24, 2004, the Community Development Department approved Lot Line Adjustment application PA- <br /> 0400293 to adjust the lines of four parcels, one of which was classified as a non-residential building site by <br /> PM-79-0192. As a result, Condition of Approval 1.e.(1) states that Parcel 4 (now 49.85 acres in size) shall <br /> not be used as a residential building site. <br /> Development Title Section 9-878.3(d) states that for amendments to a Parcel Map or a Final Map, the <br /> review procedure shall be the Public Hearing Review procedure. <br /> Findings <br /> Development Title Section 9-878.4(c)states that for amendments to a Parcel Map or Final Map, the Review <br /> Authority shall find that all of the following are true: <br /> 1. There are changes in circumstances which make any or all of the conditions of such map no longer <br /> appropriate or necessary. <br /> 2. The amendments do not impose any additional burden on the present fee owner of the property. <br /> 3. The amendments do not alter any right, title, or interest in the real property on the recorded map. <br /> There are no additional findings required to approve a Revision of Approved Actions application to a Lot <br /> Line Adjustment application because the Lot Line Adjustment application is a ministerial application. <br /> Proposed Revision of Approved Actions <br /> If the Revision of Approved Actions application for PM-79-0192 is approved, a Certificate of Correction will <br /> be recorded on Book 8, Page 82, which will effectively remove the note stating that Parcel B (Parcel 4) is <br /> not to be used as a residential building site. <br /> If the Revision of Approved Actions application for Lot Line Adjustment application PA-0400293 is approved, <br /> Condition of Approval 1.
