*PW0NE;M?40"1Z1 <br /> SAN JOAQUIN COUNTYCOMMUNITY DEVELOPMENT DEPARTMENT I=E.HAZELTON AVE.,STDCKTON,CA Y52W-602 <br /> FAX:091450-4163 <br /> October 5, 2004 <br /> MEMORANDUM <br /> TO: Development Committee �✓ <br /> FROM: Gillian Hayes, Assistant Planner <br /> SUBJECT: RE PP VED ACTIONS APPLICATIONS PM-79-0192 <br /> A DPA-04002 STANLEY ROBERTSON C/O QUARTAROLI & <br /> A PJL24 h-1cJNE � <br /> The applicant has submitted the above referenced Revision of Approved Actions to <br /> remove the condition of PM-79-0192 that states that Parcel B is not a residential building <br /> site and remove condition 1.e.(1) of Lot Line Adjustment PA-0400293, that requires the <br /> Notice of Lot Line Adjustment to include a note stating that Parcel 4 shall not be used as <br /> a residential building site. <br /> The General Plan Designation for the project parcel is OS/RC (Open Space/Resource <br /> Conservation) and it is zoned AG-40 (General Agriculture-40 acre minimum). <br /> The project site is located on the south side of W. Linne Road approximately 800 feet <br /> west of S. Chrisman Road, south of Tracy. <br /> Background <br /> On June 13, 1979, the San Joaquin County Planning Department approved PM-79-0192 <br /> to subdivide a 59 acre parcel into two 29.5 acre lots. The purpose of the subdivision <br /> application was to settle an estate between two family members. Because the proposed <br /> subdivision was considered "inconsistent with the agricultural designation of the <br /> property", a condition was placed on the Parcel Map stating that Parcel B would not be a <br /> residential building site. <br /> On June 24, 2004, the Community Development Department approved Lot Line <br /> Adjustment application PA-0400293 to adjust the parcel lines of four parcels, one of <br /> which was classified as a non-residential building site by PM-79-0192. As a result, <br /> Condition of Approval 1e.(1) states that Parcel 4 (now 49.85 acres in size) shall not be <br /> used as a residential building site. <br />
