Surfacing Modification <br /> The Site Plan depicts surfacing of recycled asphalt and aggregate base from county road reconstruction <br /> that is annually treated with calcium chloride to prevent dust. Pursuant to Development Title Section 9- <br /> 1015.5(e), all parking spaces, driveways, and maneuvering areas shall be surfaced and permanently <br /> maintained with asphalt concrete or portland cement concrete to provide a durable dust free surface. <br /> However, Development Title Section 9-1015.5(e)(2), states that, at the discretion of the Review Authority, <br /> alternative surfacing materials may be used in combination with an asphalt concrete_or portland cement <br /> concrete driveway for truck parking in agricultural zones. The applicant submitted a letter dated May 14, <br /> 2018 requesting a modification to the surfacing requirement to allow surfacing of recycled asphalt and <br /> aggregate base from county road reconstruction for all areas including the driveway. The Community <br /> Development Department has reviewed the request and is requesting that, in order to provide dust <br /> mitigation and prevent debris in the county right-of-way, the Planning Commission require the first one <br /> hundred feet of the driveway, from the edge of the existing right of way of N. Locust Tree Road, to be <br /> paved pursuant to Development Title Section 9-1015.5(e). <br /> Neighbor Response <br /> The Community Development Department has received one (1) letter expressing concern regarding this <br /> application. The letter was submitted an adjacent property owner. The concerns stated in the letter <br /> include noise, land use compatibility, and property value impacts. <br /> Noise: The neighbor expressed concern about the proposed projects' impact from noise. Development <br /> Title Section 9-1025.9(b)(5) states that noise sources emanating from any agricultural operation are <br /> exempt from the noise ordinance. Furthermore, the San Joaquin County Right-To-Farm Ordinance <br /> (Section 6-9004(3)) recognizes and supports the right to farm agricultural lands in a manner consistent <br /> with accepted customs, practices, and standards. Residents of property on or near agricultural land <br /> should accept the inconveniences or discomforts associated with agricultural operations or activities, <br /> including but not limited to noise, odors, insects, fumes, dust or the operation of machinery during any 24- <br /> hour period. San Joaquin County has determined that inconveniences or discomforts associated with <br /> such agricultural operations or activities shall not be considered a nuisance. Surrounding land uses to the <br /> north, south, east, and west include agricultural row crops and single-family residences with detached <br /> accessory buildings on agriculturally zoned parcels. Therefore, any noise or odor related impacts are <br /> considered to be less than significant. <br /> Land Use Compatibility: The neighbor expressed concern regarding land use compatibility with his <br /> residence immediately adjacent to the proposed operations. The applicant has applied for use types - <br /> Agricultural Truck Parking and Farm Services - which can be conditionally approved in the AG-40 <br /> (General Agriculture, 40 acre minimum) zone with an approved Site Approval application. The subject <br /> parcel and surrounding parcels and area are zoned AG-40. Therefore, approval of these uses would be <br /> consistent with the requirements and policies of the Development Title and General Plan. <br /> Property Value: The neighbor expressed concern about the proposed projects' possible negative impact <br /> on the value of his property. Analysis of property values is not necessary to recommend approval of the <br /> project, as these impacts are not considered in the required Development Title findings for a land use <br /> application and are not directly related to land use. <br /> San Joaquin County PA-1600128/Mettler <br /> Community Development Page 5 <br />
