Analysis <br /> Location of Squab <br /> In order to ensure that the birds are maintained a safe distance from adjacent parcels, all structures <br /> containing animals must be a minimum distance of 100 feet from the nearest property line. (Development <br /> Title Table 9-1045.3)The submitted site plan shows the proposed squab raising building with a rear yard <br /> setback at a minimum of 150 feet and the nearest side yard setback at 100 feet. Therefore, the proposed <br /> project meets this requirement. <br /> Waste Manaclement <br /> The Environmental Health Department is recommending, as a condition of approval, that the applicants <br /> submit a Manure/Solid Waste Management Plan with vector control measures. The Manure/Solid Waste <br /> Management Plan "ensures that wastes from these operations are handled in a manner that provides <br /> pubic health protection, protects local and surface ground water quality and minimizes the harborage and <br /> breeding of vectors such as rodents and insects.' Furthermore, all related liquid and solid waste produced <br /> by the project is required to remain on-site. The applicants are proposing to spread and incorporate any <br /> accumulated manure on the parcel. <br /> Council of Governments <br /> San Joaquin County is a signatory to the San Joaquin County Multi-Species Habitat Conservation and <br /> Open Space Plan (SJMSCP). Participation in the SJMSCP satisfies requirements of both the state and <br /> federal endangered species acts, and ensures that any impacts are mitigated below a level of <br /> significance in compliance with the California Environmental Quality Act (CEQA). Although participation <br /> in the SJMSCP is voluntary, if applicants choose against participating in the SJMSCP, they will be <br /> required to provide alternative mitigation in an amount and kind equal to that provided in the SJMSCP. <br /> This project is subject to the SJMSCP and is located within an unmapped land use area. Per <br /> requirements of the SJMSCP, unmapped projects are subject to case-by-case review. The applicants <br /> have indicated that they will participate in the San Joaquin Council of Governments Multi-Species Habitat <br /> Conservation and Open Space Plan (SJMSCP) to reduce any impacts to biological resources resulting <br /> from the proposed project to a level of less-than-significant <br /> Williamson Act <br /> This parcel is subject to Williamson Act contract No. 78-C1-67. The contract restricts development to uses <br /> that are compatible with the Williamson Act and Development Title Section 9-1805. "Compatible use" as <br /> defined in the Wilfiamson Act includes uses determined by the County to be compatible with the agricultural, <br /> recreational, or open-space use of land within the preserve and subject to contract. (Government Code <br /> Section 51201[e]) On July 20. 1992 the Board of Supervisors adopted Ordinance 3675 finding that Animal <br /> Raising is compatible with the Williamson Act. The project is a compatible agricultural use of the land and is <br /> a compatible use with the Williamson Act. <br /> Neighborhood Opposition <br /> The Community Development Department has received four letters of opposition.
