n <br /> k <br /> Development Title Section 9-110.4 defines an agricultural operation as any land-related <br /> activity on agriculturally zoned lands whose purpose is cultivating or raising plants or <br /> animals. Development Title Section 9-1025.9(b)(5)states that noise sources emanating <br /> from any agricultural operation are exempt from the noise ordinance. In addition, the <br /> project is not a noise sensitive land use. (Development Title Table 9-1025.9) <br /> Furthermore,the San Joaquin County Right-To-Farm Ordinance (Section 6-9004(3)) <br /> recognizes and supports the right to farm agricultural lands in a manner consistent <br /> with accepted customs, practices, and standards. Residents of property on or near <br /> agricultural land should accept the inconveniences or discomforts associated with <br /> agricultural operations or activities, including but not limited to noise, odors, insects, <br /> fumes, dust or the operation of machinery during any 24-hour period. San Joaquin <br /> County has determined that inconveniences or discomforts associated with such <br /> agricultural operations or activities shall not be considered a nuisance. . <br /> • Potential spread of specific diseases associated with birds and contamination to the surrounding <br /> environment. The specific diseases addressed are Exotic New Castle Disease (a strain of PMV- <br /> 1), West Nile Virus, Histoplasmosis and Salmonella. <br /> The United States Department of Agriculture (USDA) states that Exotic Newcastle <br /> Disease is transmitted from infected birds to healthy birds through bird waste or bird <br /> secretions. However, the USDA states that it is not harmful to people, nor is it a public <br /> health threat. <br /> The Center for Disease Control (CDC) states that West Nile Virus is contracted to <br /> humans from mosquitoes that may feed on infected birds. However, the CDC also <br /> states that even in areas where the virus is circulating, very few mosquitoes are <br /> infected with the virus; less than 1% of people who get bitten become infected. <br /> The USDA states that Histoplasmosis is a disease associated with accumulated bird <br /> waste.The CDC states that young birds also may carry Salmonella in their waste; <br /> Salmonella is primarily transferred through raw food. <br /> The USDA states that eo le at highest risk of exposure to bird related diseases are <br /> p p 9 <br /> those in direct and immediate contact with birds, bird roosts and bird waste. However, <br /> such risk factors associated with contracting and transmitting diseases can be <br /> G mitigated and minimized through confining squab within their coops, proper <br /> l management of the bird waste and proper cleaning before and after bird handling. <br /> Furthermore, to provide public health protection, the Environmental Health Department <br /> is recommending, as a condition of approval,that the applicants submit a Manure/ <br /> Solid Waste Management Plan with vector control measures. Additionally,the <br /> applicants are proposing to spread and incorporate any accumulated manure on the <br /> parcel. <br /> • Access to the parcel from Buerer Lane, on the south side of the parcel. <br /> The Department of Public Works has determined that the subject parcel may have <br /> access from Buerer Lane as shown on Parcel Map Book 34, Page 78, and Maps and <br /> Plats Book 8, Page 21.
