CONDITIONS OF APPROVAL <br /> GX-94-2 <br /> STEVE MCKEE <br /> Unless otherwise specified, all Conditions of Approval and Ordinance Requirements shall be <br /> complied with prior to commencement of grading and/or excavating. <br /> The approval will expire 18 months from the date of approval unless (1) all Conditions of Approval <br /> have been complied with, (2) all necessary permits have been secured and remain in force, and (3) <br /> all necessary permits from other agencies have been secured and remain In force. <br /> Those conditions followed by a Section Number or other Statutory Requirement are based on <br /> Ordinance Requirements. Ordinance Requirements cannot be modified. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT: <br /> a. The average finished grade elevation shall be no lower than 10.15 feet. (Development <br /> Title Section 9-1410.3{b}141) <br /> b. All Conditions of Approval shall be complied with and grading shall have commenced <br /> within eighteen (18) months of the date of approval. Excavation and final rehabilitation <br /> of the site shall be completed within eighteen (18) months of the start of excavation. <br /> (Development Title Sections 9-215.14 and 9-1410.3[1]) <br /> C. All private roads involved in an excavation shall be maintained so as to control the <br /> creation of dust. (Planning Title Section 9-1410.31a}) <br /> d. Excavation operations shall not be carried on during the hours from nine (9) p.m.through <br /> five (5) a.m., except during periods of declared national, state or local emergency. <br /> (Development Title Section 9-1410.31d}) <br /> e. All emissions shall be subject to the rules and regulations of the San Joaquin Valley <br /> Unified Air Pollution Control District. (Development Title Section 9-1410.31f}) <br /> f. During the excavation, the topsoil shall be set aside. Upon completion of excavation, the <br /> topsoil shall be replaced and the site leveled in conformance with the approved Grading <br /> Plan. (Development Title Section 9-1410.3[g]) <br /> g. If noxious weeds are on the site, operations shall be in accordance with instructions from <br /> the Agricultural Commissioner of San Joaquin County. (Development Title Section 9- <br /> 1410.3{h}) <br /> h. Any night lighting established on the property shall be arranged and controlled so as not <br /> to illuminate public rights-of-way or adjacent properties. (Development Title Section 9- <br /> 1410.3{e}) <br /> i.
