permit and is consistent with 40 CFR §146. 10. Within 60 <br /> days after plugging the well, or at the time of the next <br /> quarterly report, whichever is shorter, the permittee <br /> shall submit a report to the Director. The report shall <br /> be certified by the person who performed the plugging <br /> operation, and shall consist of either: <br /> (1) a statement that the well was plugged in accordance with <br /> the plan previously submitted to the Director; or <br /> (2) if the actual plugging differed from the approved plan, <br /> a statement describing the actual plugging procedure and <br /> reasons why the Director should approve such a deviation. <br /> Any deviation from a previously approved plan may be <br /> cause for the Director to require the operator to replug <br /> the well. <br /> According to 40 CFR §144 . 28 (c) (iv) , after a cessation of <br /> injection of two years, the draft permit requires the <br /> permittee to plug and abandon the well in accordance with <br /> the plan unless the permittee: <br /> (1) provides notice to EPA; and <br /> (2) describes actions or procedures, approved by the EPA, to <br /> ensure that the well will not endanger USDWs during the <br /> period of temporary abandonment. These actions and <br /> procedures shall include compliance with the technical <br /> requirements applicable to active injection wells unless <br /> waived in writing by EPA. <br /> 10. THE ADMINISTRATIVE RECORD <br /> As required by 40 CFR §124 . 9, the administrative record <br /> including the application, the draft permit, and the data <br /> submitted by the applicant, is located and available for <br /> public inspection at the Region 9 Water Management <br /> Division Office, Third Floor, 630 Sansome Street, San <br /> Francisco, CA. Copies of the draft permit and fact sheet <br /> are available for inspection at: <br /> 49-99 Cooperative Library System, Stockton - San Joaquin <br /> County Public Library, 605 North E1 Dorado, Stockton, CA <br /> San Joaquin County Law Library, Courthouse, room 300, 222 <br /> E.
