Item No . 3 _ <br /> PC : 5-18-89 <br /> UP-89-22 <br /> Page 1 <br /> RECOMMENDATION <br /> It is recommended that the Planning Commission: <br /> 1 . Approve the Negative Declaration and instruct the Clerk to <br /> file a Notice of Determination; and <br /> 2 . Approve Use Permit Application No . UP-89-22 based on the <br /> Findings in the staff report and subject to the attached <br /> Conditions of Approval . <br /> FINDINGS <br /> 1 . The establishment , maintenance, and operation of the use does <br /> not conflict with the General Plan because the proposed coge- <br /> neration plant is consistent with the General Industrial <br /> General Plan designation for the site . <br /> 2 . Adequate utilities, access roads, sanitation, drainage, and <br /> other necessary facilities have been provided, and the pro- <br /> posed improvements are properly related to the existing and <br /> proposed streets and highways because facilities are either <br /> already in place or are proposed to be provided by the appli- <br /> cant as part of this Use Permit . <br /> 3 . The property involved is of adequate size and shape to accom- <br /> modate the proposed use and all yards, building coverage, <br /> setbacks, parking areas , and other requirements of this Title <br /> because the site plan meets all Planning Title requirements <br /> for building coverage , setbacks, yards, and parking areas <br /> and, along with the recommended Conditions of Approval , will <br /> ensure that all Code requirements and other standards will be <br /> met . <br /> 4 . Issuance of the permit will not be significantly detrimental <br /> to the public health, safety, or welfare or be injurious to <br /> the property or improvements of adjacent properties because <br /> appropriate Conditions of Approval have been developed that <br /> will mitigate potentially significant impacts to a less than <br /> significant level , the project site is in an area designated <br /> for General Industrial , and all necessary services <br /> appropriate for the proposed use, as designated by the <br /> reviewing agencies, will be provided. <br /> PROJECT DESCRIPTION <br /> The applicant , San Joaquin CoGen Limited, is seeking this Use <br /> Permit to establish a cogeneration facility that will produce <br />
